Council Minutes of 5/4/88 <br />-4 - <br />Sheldon Burns, an attorney representing Darrill Pattison, and Randy Mingee of <br />3891 Woodside Drive, spokesman for residents of Amber Oaks and Bentley Drive, <br />both spoke at length and voiced their objections to the Lauren Hill Plaza <br />proposal which was approved by council earlier this evening. <br />Sharon Steiner, 5561 South Porter Road, announced receipt of a correction notice <br />from the Building Department stating that ahe was in violation of Zoning Code <br />Section 1135.02; that she would have to discontinue use and remove the bike ramp <br />currently on her property. This ramp was completed in July of 1985 and there <br />has been only one complaint about it in three years. In order to go before the <br />Board. of Zoning Appeals, it will cost her $30 to find out whether it is a <br />permitted use or not, and will not be able to appear for a hearing before July <br />or August. Mr. Gareau advised that if an appeal is filed, the ramp may con- <br />tinue to be used until the ruling is made by the BZA. <br />Mr. McKay moved that the $30 fee be waived and that the ramp continued to be used <br />until a ruling is .made by the Board of Zoning Appeals, second by Mr. Boehmer, <br />unanimously approved. <br />Building Commissioner Conway pointed out that another appeal regarding a skate- <br />board ramp has been scheduled for the June meeting of the BZA which could answer <br />the question about ramps depending on the board's ruling. Law Director suggested <br />that the two cases be joined and heard at the same time. Mr. Conway agreed that <br />they could be heard as one case. <br />Mr. Boehmer moved that the $30 fee be waived on the skateboard case as well, <br />second by Mr. McKay. Roll call on motion: Affirmative vote: Boehmer, McKay, <br />Tallon, Bohlmann. Negative vote: Bahas, Wilamosky. 4 Aye - 2 Nay - Motion carried. <br />Mrs. Bahas explained her "no" vote: she is not against waiving the skateboard fee <br />but against the procedure of council in voting on something before the case had <br />been presented to council; feels this is inappropriate. <br />Mr. Wilamosky explained that he had voted "no" because he did not wish to set a <br />precedent in waiving fees for cases going before the BZA; there was some ex- <br />ception, he felt, in the bike ramp case because the people involved were here to <br />present this particular case to council. A number of people in the audience then <br />announced that they too were in attendance supporting the skateboard issue. <br />Mr. Wilamosky replied that he was unaware of their presence on this matter; it had <br />not been stated. <br />Glenn Vannoy, 4811 Clague Road, discussed Ordinance No. 88-54 and 88-55. While <br />being 1007 behind Ordinance No. 88-54, he feels that Ordinance No. 88-55 should <br />be amended to allow North Olmsted buses and school buses to make the turn going <br />westerly on Brookpark Road, going south, between 7 and 9 A.M. The city bus goes <br />south and turns, going up Mastick Road towards Fairview. The school bus is <br />picking up children. <br />Steve Schneid, 25105 Randall Drive, Alex Everhart, 3570 Beaumont Drive, and <br />James Haas, 28520 Spruce Drive, addressed council, presented pictures and a <br />model of the skateboard currently under construction as well as a list of <br />rules governing its operation. President Saringer explained that they would be <br />allowed to continue the construction of the ramp with the understanding that if <br />the Board of Zoning Appeals rules against them at the June hearing they would have <br />to tear it down. <br />t~r•s:xX ~_.,. . <br />
