Council Minutes of 4/5/88 -4- <br />whether or not the characterization of that phone conversation was as Mr. Kostrek <br />said. Mr. Tallon stated that after reading Mr. Gareau's letter and the attached <br />transcript, he found that Mr. Gareau had acted in a courteous and professional <br />manner. Mr. 'Tallon moved to include the letter and telephone transcript as part <br />of the official minutes of council, second by Mr. Wilamosky, unanimously approved. <br />Audience participation: <br />Betsy Jack, 5975 Columbia Road, Administrator of the Senior Center, invited every- <br />one to attend an auction to be held on April 30th by the Senior Citizens; a lunch, <br />sweets and coffee will be available. <br />LEGISLATION: <br />Ordinance No. 88-28 introduced by Mayor Petrigac was given its third reading. <br />An ordinance for the replacement (within the right-of-way only) of McKenzie Road <br />(CR-86) over an unnamed creek, 6,488.2 feet north of Cook Road. Mr. Wilamosky <br />moved for adoption, second by Mr. Tallon, unanimously approved. Ordinance No. <br />88-28 adopted. <br />Ordinance No. 88-29 introduced by Mr. Tallon was given its third reading. An <br />ordinance granting the extinguishment and release of a sewer easement granted <br />to the City of North Olmsted and recorded in Volume 11663, Page 681, of <br />Cuyahoga County Plat Records, and declaring an emergency. Mr. Tallon moved for <br />adoption, second by Mr. McKay, unanimously approved. Ordinance No. 88-29 adopted. <br />Ordinance No. 88-30 introduced by Mr. Tallon was given its third reading. An <br />ordinance granting the extinguishment and release of a utility easement granted <br />to the City of North Olmsted and recorded in Volume 238, Page 65, of Cuyahoga County <br />Plat Record, and to further accept a new easement in place thereof, for the <br />installation and maintenance of sewers, for the purpose of supplying sewer service <br />to Hastings Drive properties. Mr. Tallon moved for adoption, second by Mr. <br />Bohlmann, unanimously approved. Ordinance No. 88-30 adopted. <br />Ordinance No. 88-31 introduced by Mayor Petrigac was given its third reading. <br />An ordinance authorizing the Mayor to enter into an agreement with the Westshore <br />Council of Governments to provide fora Hazardous Materials Response Team, and <br />declaring an emergency. Mr. McKay moved for adoption, second by Mrs. Bahas, <br />unanimously approved. Ordinance No. 8$-31 adopted. <br />Ordinance No. 88-34 introduced by Mr. Tallon was given its second reading. An <br />ordinance amending Section 1139.08 of the North Olmsted Zoning Code entitled, <br />"Access Located Within District". <br />Ordinance No. 88-35 introduced by Mr. Wilamosky was given its second reading. <br />An ordinance establishing a Casualty Loss Reserve Fund for the purpose of main- <br />taining an account from wh ich to draw in the event the City either sustains a <br />casualty loss or has a claim filed against the City wherein the City is obligated <br />to absorb a loss due to the deductable in the City's Insurance Program, and de- <br />claring an emergency. <br />Ordinance No. 88-36 introduced by Mr. Tallon was given. its second reading. An <br />ordinance creating a new Paragraph (C) to Section 1139.04 of the Zoning Code <br />entitled, "Setback", and also providing for thirty-f ive foot setback area in <br />Retail Business Districts when certain conditions are met. <br />
