Council Minutes of 3/15/88 -2- <br />Law Director Gareau reported: 1) Law Director successfully defended the City with <br />respect to the Newman Case; Judge ruled in favor of the City of North Olmsted. <br />At this time, does not know if an appeal will be entered. <br />2) Last week, argued the Slifka Case in the Court of Appeals, dealing with the <br />water rates; is hopeful of getting a reversal of Judge McMonagle's decision. <br />3) Is in the process of preparing a brief with respect to the School Guard Case. <br />4) Attended an UMTA Conference with Bus Line personnel in New Orleans; discussions <br />covered suburban problems which the city is now encountering; Law Director re- <br />cevied a lot of information on this subject. Will be looking at the possibility <br />that the City of North Olmsted, through RTA, could get a grant to study various <br />routes between the Rapid Transit, the City of North Olmsted, and the airport. <br />Finance Director Boyle reported: Last night, Mayor Petrigac and Finance Director <br />attended a round table arranged by the Citizens League and the Governmental <br />Research Institute to look into the affects of federal funding; no one is really <br />getting any federal money now but past usage of federal .funds was discussed. <br />There is another meeting this evening with some of the larger cities for discussion <br />and hopefully, in mid-April, will report their findings which can then be used <br />by different cities in responding to current dilemmas with federal funding. <br />2) Is happy to have the Clerk of Council back on the job; does not believe anyone <br />can appreciate the volume of work that flows through the clerk's office until they <br />have to take it over. <br />Mr. Bohlmann, Chairman Intro-Goverrunental Relations and Legislative Committee <br />as well as Recreation, Public Parks and Buildings Committee reported: 1) Resolu- <br />tion No. 88-21, rejecting the recommendation of the Fact Finder within seven <br />days and stipulating that thirty days would permit more time to reasonably review <br />and evaluate the Fact Finder's recommendations, is on tonight's agenda; committee <br />recommends adoption. <br />2) Committee also recommends adoption of Ordinance No. 88-24, adopting a new <br />and revised Chapter 1361, entitled "Flood Damage Prevention". <br />Mr. McKay asked anyone with input with respect to the vacation of South Canterbury, <br />Pebblebrook Subdivision, to please let him know so committee will know in what <br />direction to proceed. President Saringer suggested Mr. McKay meet with the BZD <br />Committee and come up with a recommendation for council. <br />Mr. Wilamosky, Chairman Finance Committee reported: 1) Finance Committee met on <br />March 3rd with Directors Cunningham and Noble in attendance as well as Commissioner <br />Wolff. Various line item of the Service Department were discussed. <br />2) Committee again met on March 7th with Tom Fattler and Mr. O'Rourke and Mr. Smith <br />from the Recreation Commission also in attendance. Committee discussed various line <br />items within the Recreation Fund. Will recommend that the Pro Shop stock line item <br />be adjusted and another line item, Equipment Purchase, be included. <br />3) Committee met on March 9th with Director Noble and Superintendant Crider, Waste- <br />water Treatment Plant. Administration's appropriations reflect a shortage in the <br />utility line item of approximately $200,000. Realistically, an increase in <br />sewer rates is needed. Would request President Saringer to schedule a Council of <br />the Whole Committee Meeting to discuss negotiations with Olmsted Township and <br />Fairview Park. If rate adjustments are necessary, council will have ample time to <br />make them and will be able to plan a little bit better with respect to appropriating <br />dollars within the Treatment Plant for operation and maintenance. <br />4) Committee met again on March 14th - basically recapped the earlier meetings. <br />Discussed with Finance Director Boyle his department's needs. <br />5) Committee also discussed Ordinance No. 88-17, amending tap-in fees for Olmsted <br />Township and North Olmsted; will ask for .suspension of rule requiring three readings <br />in order to pass this legislation, as amended, this evening. <br />L <br />
