a <br />Council Minutes of 2/16/88 -4- <br />Mr. Bohlmann, Chairman Intra-Governmental Relations and Legislation Committee <br />reported: 1) Legislation Committee met on February 15th for the purpose of <br />interviewing Mr. Anthony M. Smeraldi to fill the vacancy on the Landmarks <br />Commission; committee unanimously recommends his appointment. Mr. Bahlmann moved <br />Council approve the appointment of Mr. Anthony Smeraldi to the Landmarks <br />Commission, for a two year term commencing. February 16, 19$8 through December 31, <br />1989, second by Mr. Wilamosky, unanimously approved. <br />Mr. Boehmer, Chairman Public Safety, Health and Welfare Committee reported: <br />1) Meeting was held February 10th with Transportation Cotunnittee. Committee dis- <br />cussed erection of a pay phone at Clague and 1480; no decision was made; committee <br />will look into cost and other factors. <br />2) Committee discussed street lighting to be paid for by residents or commercial <br />businesses on Lorain Road; no decision was reached, <br />3) Committee briefly discussed fire and police equipment; will await presentation <br />of the appropriation ordinance to see what funds will be made available. <br />4) Moved Council have no objection to the issuance of an F2 liquor permit for the <br />Church of St. Clarence, 30106 Lorain Road, for a function to be held on Sunday, <br />March 13, 1988, second by Mr. O'Grady, unanimously: approved. <br />5) Moved Council have no objection to the issuance of an F2 liquor permit for the <br />Knights of Columbus Council No. 4731, for a function to be held at 30106 Lorain Road, <br />on Friday, April 29, 1988, second by Mr. O'Grady, unanimously approved, <br />Audience participation: <br />Jim Betts, lawyer and resident of Rocky River, appeared as legislative consultant <br />to an organization called Ohio Pesticide Applicators for Responsible Regulation, <br />OPARR. Mr. Betts discussed various sections of the Ohio Revised Code covering <br />pesticides. Pointed out that the federal congress, in 1970's adopted the <br />Federal Insecticide, Funguscide, Rodenticide Act (FIFRA) which specifically pre- <br />empts local communities from regulating the utilization of pesticides. Discussion <br />continued. <br />LEGISLATION: <br />Ordinance No. 88-3 introduced by Mr. McKay was given its third reading. An <br />ordinance enacting a new Chapter 759 of the Codified Ordinances of the City of <br />North Olmsted to provide for registration of users of pesticides and pesticide <br />products and for not if ication to registered residents, and declaring an emergency, <br />as amended. Mr. McKay moved Ordinance No. 88-3 be placed back into committee, <br />second by Mr. Boehmer, unanimously approved. Ordinance No. 88-3 returned to committee <br />Ordinance No. 88-4 introduced by Mr. Tallon was given its third reading. An <br />ordinance accpeting for dedication the Pebblebrook Subdivision which includes <br />Walnut Lane, Pebblebrook Lane and Sandpiper Lane in the City of North Olmsted. <br />Mr. Bohlmann moved for adoption, second by Mrs. Bahas, unanimously approved. <br />Ordinance No. 88-4 adopted. <br />Ordinance No. 88-5 introduced by Mr. Bohlmann was given its third reading. An <br />ordinance to approve current replacement pages to the Codified Ordinances; to adopt <br />new matter, and declaring an emergency. Mr. Bohlmann moved for adoption, second by <br />Mrs. Bahas, unanimously approved. Ordinance No. 88-5 adopted. <br />Ordinance No. 88-7 introduced by Mr. O'Grady was given its third reading. An <br />ordinance authorizing the .Building Commissioner to proceed with the demolition <br />or removal of the detached garage located at 3320 Clague Road, in the City of <br />North Olmsted, and declaring an emergency. Mr. O'Grady moved for adoption, second <br />by Mr. Boehmer, unanimously approved. Ordinance No. 88-7 adopted. <br />,, ;..- _. <br />
