Council Minutes of 1/19/88 _2_ <br />7) Requests the Chairman of the Legislative Committee to proceed with the <br />appointment of Tom Restifo to fill the vacancy on the Architectural Review <br />Board for a two year term, January 1, 1988, through December 31, 1989. <br />Law Director Gareau reported: 1) In the last two or three months, has scheduled <br />depositions in the Faughender Case; they have been continued. Is in a position <br />to file a motion for summary judgment but needs one more deposition before doing <br />so and that has been scheduled for two weeks from now. <br />2) Also had a deposition scheduled in the Cooper Case; is deposing the attorney <br />who claims he has $190,000 in outstanding attorney fees. Law Department has for- <br />warded a notice to take his deposition, asking him to bring all his calendars <br />and various office records to determine whether or not the fee he is claiming <br />is appropriate. <br />3) Had a pre-trial scheduled in the Halleen Case; attorney for Halleen requested <br />a continuance because of communications that have not been received from General <br />Motors Corporation. There is an agreement that between now and the time of the <br />next pre-trial, the overhead lights will be extinguished and the lower lights <br />will be on but will be turned off at closing time. Two days a week, the closing <br />time is 9 P.M. so they will be extinguished at 6 P.M. or shortly thereafter on <br />Tuesday, Wednesday, Friday and Saturday. They will not be lit an Sunday at all <br />and on Monday and Thursday they will be on until 9 P.M. or shortly after closing <br />time. While he has not checked, Law Director would hope they are following the <br />guidelines they agreed to. <br />Finance Director Boyle reported: 1) Finance Department has been implementing the <br />new payroll system and closing the books for 1987. Financial statements will be <br />placed in council packets as well as being delivered to various departments this <br />week. <br />2) Met with Squire, Sanders and Dempsey on the sewer agreement with Olmsted Town- <br />ship. At a later meeting with Squire, Sanders and Dempsey, as well as Harry Crider <br />from the Wastewater Treatment Plant, attempted to develop tentative billings for <br />the Township; should begin on that next week, along with billings to Fairview Park <br />and hopefully this contract will lay the ground work for the new Fairview Park <br />contract. <br />Mr. Wilamosky, Chairman Finance Committee reported:. 1) Although there was no <br />Finance Committee Meeting held, would like to briefly report on the Council of the <br />Whole Committee Meeting held on January 18th. All members of council were present <br />with the exception of President Saringer and Councilman Boehmer. Council dis- <br />cussed legal opinion No. 88-1, requested by Mr. Wilamosky, regarding council's <br />ability to hire a Fart-time Planner. This legal opinion states that council does <br />have the authority to hire and can enter into a contract for the purpose of <br />establishing terms and conditions of employment. The opinion also states, "under <br />Section SA, Article 3 of the Charter, the Mayor is under duty to execute, that is, <br />sign all written contracts to which the city is a party." Those in attendance at <br />the meeting did concur and agree to wait until after the meeting with the admin- <br />istration on January 25th to discuss the administration's proposal regarding a <br />planner. <br />Mr. McKay, Chairman Environmental Control Committee reported: 1) Committee met on <br />January 11th with Councilmen Boehmex, Tallon and Wilamosky also in attendance. <br />Committee discussed Ordinance No. 88-3 which requires commercial users of pesti- <br />cides to register with the Safety Director and notify abutting residents of any <br />property they treat. The purpose of this is to give neighboring residents an <br />opportunity to keep their children and/or pets off of treated lawns. Committee <br />has no objection to Ordinance No. 88-3. <br /> <br />
