.~ <br />Council Minutes of 12/19/89 -2- <br />Law Director Gar eau reported: 1) There have been ongoing negotiations and dia- <br />logue with the Attorney General's office regarding the settlement of the tap-in <br />ban. Has been trying to identify the problems that can be more easily resolved; <br />if, in fact, a problem cannot be resolved, then will move on to the next thing. <br />All of the departments have been cooperative in trying to find solutions. Pretty <br />much know that the sewer pipes in the Deerfield area are fairly sound but suspect <br />there is more inflow than infiltration due to the connection of downspouts. <br />Will concentrate on this area with the use of TV cameras and, if necessary, by <br />running dye tests, in order to present a proposal to EPA regarding the resolution <br />of these flooding problems. Hope to solve the problem by using time schedules to <br />find out where there are cross connections, where sump pumps are tied into sani- <br />tary sewers and getting the cooperation of the people in the area who are causing <br />their neighbors the problems. If there is a lack of cooperation, will have to <br />put some teeth into efforts to force some of the people, who are illegally <br />connected, to disconnect. Believes this will take care of a lot of the problems <br />in the Deerfield area, however, in the long. .run, will have to look at the storm <br />sewer problems. Does not know if this is going to be part of the EPA Agreement <br />but Mayor Petrigac has already started by going to Washington, D.C. and hopefu]_ly, <br />the new administration will pick up on this and also get some cooperation from <br />the City of Westlake. <br />Finance Director Boyle reported: 1) Has applied far the Real Estate Persgnal <br />Property Tax Advance Program which tends to increase th.e city's investment <br />portfolio and revenues. <br />2) Has been in contact with Blue Cross who is going to stop .the Rate Stabiliza- <br />tion Plan effective the beginning of 1990. In this plan, the city pays intq <br />Blue Cross monthly; they withhold a portion of this against catastrophic <br />illnesses they may have to pay and credit.. what they have to pay against it. There <br />is about $216,000 in this account right now. This accqunts £pr their prof its <br />because it is a profitable venture and they are withholding against thecty's <br />claims. They are one of the few companies actually doing this right now. They <br />are going to back off a bit and have offered the city $72,016, They .really do <br />not have to offer the city anything but they are gf~ering everybpdy a portion of <br />their rate stabilization. They will issue .the city a check fps this amount and <br />we can use it against future billings. Finance Director prefexs tc~ lggk into <br />possibly funding self-insured hospitalization; not totally self-.i~tsured - it <br />would be an umbrella policy or going to a deductible with the deductible portion <br />being held in the city. Has discussed this with. council over the last few <br />years and will continue to report once the Blue Cross deal is .closed. <br />3) Had been in contact with the State of Ohio with respect to the 1990 audit but <br />has not yet received any word from them. Contacted Arthur Xqung and Company, <br />the firm who has done the city's audits far the last five years, and .they will <br />conduct the annual end-of-the-year inventory. This will be the ].east expensive <br />and the least hassle for the city employees. <br />4) As Mayor-Elect would like to announce the following appointments: Ralph Bohlmann, <br />Service Director; Ernie Gundy, Safety Director; Don Copeland, Director of Human <br />Resources; Estella King, Senior Center Administrator; Nancy Wlodarsky, Administrative <br />Assistant; Linda Spencer, Mayor's Secretary; Min Crumbley, Service Director's <br />Secretary. Since Mr. O'Neil, Building Department electrical inspector, is retiring, <br />will probably be hiring a full time inspector since this is Building Commissioner <br />Conway's preference. This is still being discussed. Will also be appointing a <br />Charter Review Commission and would appreciate council's input regarding possible <br />charter changes.
