Council Minutes of 10/3/89 <br />-2- <br />Commenting on the Mayor's report, Councilman Wilamosky stated that Consulting <br />Engineer Cesen's report to her failed to mention the fact that he had already <br />approved off-site retention, not on-site retention, with respect to Metro Lexus. <br />Feels it should be stated, for the record, that after Councilmen Bohlmann and <br />Wilamosky met with Mr. Cesen and the contractor, they agreed to add 100 feet of <br />5 foot pipe which will provide for 7,000 additional gallons of underground re- <br />tention. <br />Law Director Gareau reported: 1) Law Department is appealing the Clark Oil Case <br />with the brief due in November. <br />2) During the past few weeks, Law Department has been very actively involved in <br />personal injury cases not being handled by the insurance company. One case, <br />Cooper versus the City of North Olmsted, concerns a trailer which came loose from <br />a Service Department vehicle and struck a car. Law Director has submitted the <br />interrogatories and pre-trial will be held this coming Thursday. <br />3) The Schwartz Case, where someone fell in front of the McDonald Headquarters, <br />was settled today; North Olmsted paid no money; it was paid by the property owner <br />and the person occupying the property. <br />4) Pre-trial. was held with respect to the Conlin Case dealing with a sewer grate <br />on David Drive. Medical reports are expected; if case cannot be settled, it will <br />go to arbitration in January. <br />5) Last week, Law Department had a motion-to-show-cause hearing on the Bryan Case. <br />Def endant in that- case did. not show up and case was continued to this Thursday. <br />Law Department has been instructed to prepare papers for purpose of having an <br />arrest warrant issued for Mr. Bryon -failure to comply. <br />Finance Director Boyle reported: 1) Finance Department is in receipt of the annual <br />statements from Regional Income Tax Agency for 1988 as well as from the Rocky River <br />Court System; they are available for inspection in the Finance Office. <br />2) There has been a lot of talk about annexation of Olmsted Township. Readers of <br />the Orange Line might notice that a portion of North Olmsted seems to have been <br />annexed. Not true; they simply failed to list the southern end of McKenzie, Nancy, <br />Louant-,Holly, and the Olmsted Colony district. <br />3) Had occasion to read a piece of political literature that stated, "When I <br />took office, I found the city besieged with problems; the first problem being un- <br />paid and over-due bills". This is a reflection on the Finance Department that if <br />true would have been evidenced in the independent audits conducted by Arthur Young <br />and Company. If true, would have been evidenced in an adverse response by <br />Moody's of New York, possibly to the extent of being called to New York and <br />the city's credit rating being looked into. Does not think this is good politics; <br />does not think it is called for. Such a statement can adversely affect the city's <br />credit rating. A drop in the city's credit rating is approximately a half percent <br />interest on any borrowed money. Since Mr. Boyle has been Finance Director there <br />has been as much as nine million dollars on short term borrowings and this is what <br />would be affected by such statements. Other people in North Olmsted really handle <br />the paying of bills more than Director Cunningham, Off ice of Budget and Management, <br />and Director Boyle, Finance Department. These are the employees of the two de- <br />partments as of 1985. Mrs. Bensi and Mrs. Purper should not be condemned for any- <br />thing, especially something that did not happen, and when it must be remembered <br />that they were working on their own - there was no director. Finance Department <br />employees, Mrs. Lilly, Mrs. Spencer and Mrs. DeMore also should not have been <br />brought into this. Does not believe in using politics in such a way that it can <br />adversely affect the credit rating of the city. Would not bring it up at this <br />council meeting except it is not just political - it does have an affect on <br />council members as a council and as legislators. <br /> <br />
