Council Minutes of 8/15/89 _2_ <br />8) Will be introducing Ordinance No. 89-72 covering the reconstruction and re- <br />surfacing of Butternut Ridge Road. City will handle the engineering, inspection <br />and administration in-house at no cost to the city. This project will coincide <br />with the Fitch Road Project, both of which will be funded through license plate <br />money. City hopes that both projects will begin by the middle of September, <br />starting with Fitch Road first and with completion before bad weather sets in. <br />Advised Finance Director Boyle that a line item would be needed accepting the <br />check from the county and also a line item for payment to the contractors. <br />9) Cuyahoga County is presently undertaking a traffic survey in the areas of Dover <br />Center Road, Driscoll, Cottonwood, Sparky Lane, Porter, Walter, etc. <br />10) Is in receipt of Eileen Traczyk's resignation from the Planning Commission. <br />Would appreciate receiving resumes in order to fill this vacancy as soon as possible. <br />11) A ribbon cutting to officially open the Industrial Park will be held on Tuesday, <br />August 22nd, at 2 P.M. <br />12) Homecoming Days are Thursday, August 24th; Friday the 25th; Saturday the 26th <br />and will end with the parade on Sunday .the 27th. <br />Law Director Gareau reported: 1) Has filed a motion to dismiss in the Federal <br />Court Case dealing with Dingess. In response to this motion to dismiss, Dingess <br />filed a brief in opposition and Law Director is prepared to file a reply tomorrow. <br />In addition to the motion to dismiss, Mr. Gareau has filed a Rule Eleven Motion <br />which asks for sanctions against both the Dingess' and their attorney for filing <br />an absolutely frivolous case and requests payment of attorney fees and costs. <br />2) Is delighted to have concluded negotiations with AFSCME. Had previously suggested <br />that a member of council take part in these negotiations and Mr. Tom O'Grady was <br />selected to do so. Feels very strongly that this really helped to move things <br />along; Mr. O'Grad~s contributions to the negotiations were invaluable; thanked him <br />for his participation and would hope this would continue in the future. <br />3) A new lawsuit has cropped up with respect to a fall on a sidewalk in front of <br />the old McDonald's Corporate Headquarters on Lorain Road. This is currently being <br />investigated. <br />President Saringer took this opportunity to welcome back both Councilman O'Grady <br />and Clerk of Council Campbell who had both been recently hospitalized with medi- <br />cal problems. <br />Finance Director Boyle reported: 1) Over the last few weeks, negotiated, sold and <br />concluded four note issues; all of them sold through the National City Corporation <br />who were the lowest bidders. Industrial Park Notes sold at 6.337; Uac-All equip- <br />ment sold at 6.327; Traffic Signalization closed at 6.327 and the Judgment Note <br />has been paid down by $30,000 and sold at 6..327. The last three notes will be <br />maturing in June, along with the notes closed earlier this year. The Industrial <br />Park Notes will not mature at the same time because this is a special assessment <br />and will require a little bit more work; does not want to sell it at the same time <br />the city is making decisions on the smaller issues. This note will mature in one <br />year, August 3rd, 1990. <br />2) Appreciates Flo Campbell's return; when the Industrial Park issue closed, all <br />the paper work that required her signature had to be signed by her while she was <br />in the Cardiac Care Unit. Hopes she remains in good health since the city won't <br />operate without her. <br />3) Has received the final, direct reimbursement from the Regional Transit Authority. <br />Under the old contract, the city was reimbursed for costs. Under the new contract, <br />the city is reimbursed based on hours - platform hours and travel hours. There <br />were certain hold-over items from last year, one being the Public Employees' <br />Retirement System payment. They just disbursed that money to the city, in time <br />to make the payment. What the city receives from RTA from now on will be just on <br />the new contract; there will be a slight decrease but it should not be too notice- <br />able. The money being received the first six months of this year was money from <br />the old contract. <br />
