Council Minutes of 2/21/89 -2- <br />Law Director Gareau reported: 1) Yesterday, attended a seminar sponsored by <br />the Cuyahoga County Law Directors' Association which covered many subjects of <br />interest to municipal corporations. <br />2) Since the last council meeting, has had .occasion to file additional motions <br />in the Dingess Case and had scheduled depositions. Filed a motion to strike <br />the amount of money asked for in the prayer because it is inappropriate against <br />municipal corporations. They, in turn, filed a motion to continue the deposition <br />for the purpose of hiring a lawyer; perhaps this action will resolve some of the <br />issues in this case instead of having numerous motions floating back and forth. <br />3) Today, had a pretrial in the case dealing with a snow plow striking the side <br />of a van. Case was originally set for trial next month but has now been post- <br />poned because the city has to take defense medicals to find out whether or not the <br />reports received are valid with respect to the injury. <br />Mr. Boehmer, Chairman Public Safety, Health and Welfare Committee reported: <br />1) Moved council have no objection to the issuance of an F2 liquor permit for <br />St. .Brendan's Parish St. Patrick's Day Committee, for a function to be held <br />on March 11th, second by Mr. O'Grady, unanimously approved. <br />2) Committee met on February 14th with all members present, including President <br />Saringer and Captain Krynak, Chief Van Kuren and Safety Director Becker. <br />Committee discussed the accident at I90 and McKinley involving the ambulance. <br />Chief Van Kuren would like to have this repaired as well as purchasing a new <br />rescue squad. There is approximately $10,000 damage incurred in the accident. <br />3) Committee also discussed traffic signalization along Lorain Road. Connnittee <br />did not have the report on traffic upgrading at the time of the meeting. A <br />further discussion will be held to go over the reports recently received from <br />Safety Director Becker. <br />Mr. Bohlmann, Chairmen Intra-Governmental Relations and Legislative Committee <br />as well as Recreation, Public Parks and Buildings Committee reported: <br />1) Legislative Committee met on February 16th to discuss Ordinance No. 88-77, <br />which covered cabin fees. A few minor changes were made and the new legisla- <br />tion covering the amendments, Ordinance No. 89-15, is on the agenda tonight. <br />2) Committee also interviewed Mr. Charles Miller, recommended by the Mayor to <br />fill the unexpired term on the Landmark's Commission. Committee has no objection <br />and recommends this appointment unanimously.. Mr. Bohlmann moved Council approve <br />the appointment of Mr. Charles Miller to serve until December 31, 1989, on the <br />Landmark's Commission, second by Mr. Wilamosky, unanimously approved. <br />Mr. O'Grady, Chairman Transportation Committee reported: 1) The Community <br />Development Block Grant Seminar basically covered the Cuyahoga Plan - housing <br />information and the handling of complaints. Testers and checkers are utilized <br />to be sure that all housing that is being rented or sold is in accordance with <br />federal laws. If they feel something is not being done, .they come to a con- <br />clusion and, if necessary, turn it over to attornys for litigation. Discussion <br />covered rental information, service agencies and housing codes. .There had been <br />primarily five classes that could not be discriminated against; two more are <br />being added; the most signif icant one is that no one can discriminate by not <br />renting to a person because they have children, especially in apartments. <br />This change is effective in March. The other added class covers persons who <br />are disabled. There is only one more seminar left and .that one will be held <br />at the University Club on February 28th; would suggest that all council. members <br />be in attendance and that the Legislative Committee schedule a Council-of-the- <br />Whole Committee Meeting to discuss this further. <br /> <br />
