'. <br />Council Minutes of 2/6/89 -2- <br />11) Administration is currently working. on the 1989 budget; much depends on the <br />outcome of tomorrow's election; hopes everyone will remember to vote. <br />12) Contract grants for engineering, cleaning and lining of Lorain Road, from <br />Butternut Ridge Road to the County Line, from Barton Road - Lorain to Cook Road,. <br />and with an additional option in the design factor to include 400 feet of existing <br />water line on Porter Road, from Mill to Lorain Road, have been awarded to <br />R. E. Warner and Associates, an engineering firm from Westlake. <br />13) Has signed an agreement with Michael Benza and Associates to prepare the de- <br />tailed plans and specs for the bidding of Elm Road. Both projects are listed on <br />the Issue Two Priority List and both came in lower than what was budgeted in the <br />temporary budget. <br />14) Requests council to approve her recommendation of Charles J. Miller to serve <br />on the Landmarks Commission. <br />Law Director Gateau reported: 1) Has received an opinion of the Eighth Appel- <br />late District Court of Appeals regarding the Citrus Trust Case; the city pre- <br />vailed in the lower court and the Eighth Appellate District sustained the <br />lower court's decision. <br />2) In the past two weeks, has filed numerous answers, motions and briefs with <br />respect to the Dingess Case, which will continue. <br />3) Although it does not appear that the. Sunset Memorial Case will go forward <br />tomorrow, Judge Nugent's bailiff has advised Law Director Gateau to be in <br />attendance tomorrow morning at 9 A.M. <br />Finance Director Boyle reported: 1) Has received the license tax fees for the <br />first twelve month period. totaling $197,359.93: $65,000+ from the county $5 tag <br />fee and $131,000+ from North Olmsted $5 tag fee. <br />2) Reviewed the impact the pool closing has had on Rec Center revenue: the <br />pool closing has affected the revenues for everything but the game machines - <br />every other line item is down below the average monthly income. <br />3) Just a reminder that forms are available in the Finance Department, from the <br />Cleveland Department of Utilities - Water Department -.for a reduction in water <br />rates for residents over 62 years of age. This can have an impact on water bills <br />although it does not affect sewer rates. <br />Mr. O'Grady, Chairman Transportation Committee, reported: 1) The Cable TV Ad- <br />visory Commission met on February 2nd with all members. in attendance. First <br />order of business was a presentation by MetroTEN Cablevision; MetroTEN i5 a <br />wireless system which operates under the same premise that a radio station would. <br />They need no permission from the city to operate within its confines nor will <br />they be paying the city a user fee. City is currently getting $62,000 per year <br />from Cablevision, along with $9,000 in rent. MetroTEN will start soliciting <br />this Summer; it is a very limited system with a very limited selection. In <br />addition to the basic package, at $10.95, they offer Showtime at $9.00 per <br />month and Disney for a total package of $26.95 for all available programming. <br />2) Committee also reviewed current programming; basically there was no input <br />from anyone on the committee with respect to complaints about the current system. <br />Committee did discuss a proposal by Senator Metzenbaum which would put some teeth <br />in the system and give cities the right to regulate rates by cablevision systems. <br />Committee requested Mayor Petrigac to send a letter to Senator Metzenbaum en- <br />couraging him to continue forward with legislation along these lines. <br />3) Any complaints with respect to.the current system should be brought to the <br />attention of Ric Coplan, at Cablevision, or to Dottie Fox, the Public Relations <br />Director at Cablevision. <br />
