t <br />Council Minutes of 12/4/90 <br />6) The Christmas tree in the lobby was donated to the City by the <br />Deerfield Civic Association. We wish to extend our thanks to the <br />homeowners and to the ladies who decorated the tree. <br />Mr. Boehmer expressed thanks to Cub Scout Pack 52 for decorating Council <br />Chambers. <br />Law Director Gareau reported: 1) We are currently working on <br />formulating our stipulations in the case of Cater vs. the City of North <br />Olmsted. <br />2) A lawsuit was received this week with respect to a spectator at a Pee <br />Wee Hockey game who was hit with a puck. State law provides the City <br />with irternmity when there is no charge for admission. Since there was no <br />admission charge at this event, we will immediately file a motion for <br />stun<nary judgment . <br />3) A motion for s~manary judgment is being prepared in the Eliza Jennings <br />case; we will also be asking for prejudgment interest. <br />Mrs. Saringer, Chairperson of the Building, Zoning and Development <br />Committee, reported: 1) The BZD Committee met this evening. In <br />attendance were Committee m~nbers, Building Commissioner Conway, and Mr. <br />Dick Will and Mr. Dennis Patton from BP. Three gas station sites are <br />being upgraded. The buildings are being cladded with aluminum and a <br />good deal of the signage is being removed. This has been approved by <br />Planning Commission, ARB, and the BZD Committee. Moved to approve the <br />upgrading of the BP gas stations; second by Mr. O'Grady; passed <br />unanimously. <br />2) Committee had no objection to the installation of a drive-up <br />telephone at Fretter's, 26635 Brookpark Extension. Moved to approve the <br />proposed phone booth by Fretter's; second by Mr. Tallon; passed <br />unanimously. <br />Mr. McKay, Chairman of the Environmental Control Committee reported: <br />1) The Westshore Solid Waste Ccxrmittee met on November 28 and the <br />guidelines for the proposed Material Recovery Facility were approved. <br />This facility will service the six Westshore co~~n~ties; the <br />specifications that were accepted are the result of the work of these <br />communities. A legal firm will be hired to assist the communities in <br />the contracting process. <br />2) Westlake has purchased a recycling truck for complete curbside <br />pickup. Lakewood reported a reduction of solid waste from one year ago; <br />they estimate the saving at $40,000. <br />3) To have some contirniity in the Committee, it was decided that <br />appointments would be staggered for one and two-year terms. <br />4) At the present time, there are 50 pieces of legislation before the <br />State, most of which are bottle bill ordinances. <br />Mr. O'Grady asked if Lakewood was picking up recyclable material. <br />Mr. McKay replied that they were. <br />2 <br />
