Council Minutes of 11/20/90 <br />g. Harmon Glass, 25570 Lorain Road, proposal to renovate an existing <br />building. This was approved by Planning Commission. The plans show an <br />enclosure for a duinpster and the BZD Committee recommended the gate on <br />the front of the dumpster be of solid type. Moved to approve the <br />proposal with the recommendations of Planning Commission and BZD <br />Committee; secorxi by Mr. Nashar; passed unanimously. <br />3) A Public Hearing will be held on December 18 at 7:15 p.m. on <br />Ordinance No. 90-142. <br />4) The next BZD Committee meeting will be December 12 at 7:30 p.m. <br />Mr. McKay, Chairman of the Enviror~ental Control Committee, announced <br />that the Westshore Solid Waste Committee will meet on Wednesday, <br />November 28 at 7:30 p.m. in Rocky River City Ha11. <br />Mr. Tallon, Chairman of the Finance Committee reported: 1) The <br />Committee concurs and supports Ordinance No. 90-141, an ordinance <br />creating new Section 1341.03 of the City of North Olmsted Codified <br />Ordinances, entitled "Street Cleaning Deposit and Fee". <br />Audience Participation: <br />Amy Watts, Biskind Development Company, addressed Ordinance No. 90-107, <br />an ordinance to rezone 1.7 acres of Single FamLily land to Mixed Use. <br />A chronology of events was given: The rezoning was first proposed four <br />years ago; Planning Conznissioar turned it down because they wanted to <br />look at the whole area anal consider appropriate zoning for the land <br />across the street as well. This past February, the rezoning was brought <br />up again and Planning CosmaLission asked the Planning Consultant to draw <br />up a proposal for the area. This plan was considered by the Plarming <br />Commission; it was decided that the 1.7 acres could be zoned to Mixed <br />Use. However, the Plarming Commission turned down the request because <br />the developer was not able to provide deed restrictions prohibiting <br />retail establishments. At a later date, the deed restrictions were <br />provided and Planning Commission approved the rezoning by a vote of 6 to <br />1. The proposal then went to BZD Committee where it passed 3 to 0. On <br />September 18, a Public Hearing was held on Ordinance 90-107 and it was <br />passed at the Council meting by a vote of 5 to 1. However, because of <br />improper ratification, another Public Hearing was held on November 7. <br />Another vote taken at the Council raeeti.ng the same evening approved the <br />ordinance by a 4 to 2 vote; however, one Council Member asked for <br />reconsideration to change the vote; the reconsideration was turned down. <br />Mayor Boyle subsequently vetoed the ordinance. At present, the <br />developer feels he will go to court. He is, however, willing to propose <br />a restriction limiting any office building to two stories and arty hotel <br />to three stories. If legal action is taken, the developer will not <br />impose any restrictions upon himself. <br /> <br />4 <br />
