~. . <br />MINUTES OF PUBLIC HEARING <br />SEPTEMBER 18, 1990 <br />7:00 P.M. <br />Public Hearing was called to order by President Boehmer at 7 p.m. <br />President BoeYmer announced the Public Hearing would cover Ordinance No. <br />90-107. An ordinance providing for the amendment of the Zoning Map of <br />the City of North Olmsted, which Zone Map is part of the Zoning Code of <br />the City of North Olmsted, by changing the premises hereinafter <br />described frosr- Single Residence A District to Mixed Use District A. <br />Audie~nce~~arti_ci~ation <br />E~een Schuler, Clareshire Road, 2-H. Four years ago, had <br />presented to Council a petition with 873 names against the rezoning of <br />these same two properties. There are 159 townhouses and apartment <br />condos on Clareshire who collectively pay $128,000 a year in property <br />taxes. Residents are concerned about the value of their property should <br />this rezoning pass. These condos have not increased in value as others <br />have in this area; residents feel buyers are leery of this area because <br />of commercial construction. Homeowners are very frustrated over trying <br />to fight against a corporate giant. The residents are calling on <br />Council for help aryl want to know that they do count. <br />Mrs. Saringer commented that attached to this legislation is a <br />declaration of restrictions that deal with the permitted use, the <br />buffer, no ingress or egress driveways from Columbia Road. These <br />restrictions would be record. with the County Recorder. <br />Angelo Skoulis, 24732 Mitchell Drive, President of Parkwest Homeowners' <br />Association. Parkwest homeowners are against this zoning request. <br />Cited item 1202.01 of the Code stating, "The m;n;rm~m required area for <br />plan of development of a parcel of land shall not be less than 10 <br />acres". The two lots in question total less than 1 acre. Technically <br />this land cannot be rezoned. <br />Mitchell Mize, representative from Biskind Development Company, said the <br />larxi in question is four parcels on which there are two homes; currently <br />it is 1.7 acres. It butts up against a Mixed Use District which is 16.5 <br />acres approximately; together that development plan would be submitted <br />for the single parcel then created which would be about 18 acres. <br />Mr. Skoulis pointed out that again that the area in question does not <br />conform to the code requirements and technically cannot be rezoned to <br />Mixed Use. <br />Mr. Boehmer suggested that this question be asked of the Law Director at <br />the Council meeting. <br />Mr. Skoulis agreed but reiterated that he and the members of the <br />Parkwest Homeowners Association were against this rezoning. It is the <br />feeling that this developer has more than enough land on which to build; <br />he recently rezoned 24 acres abutting Parkwest Development and he has 13 <br />1 <br /> <br />
