Council Minutes of 7/3/90 <br />Law Director Gareau reported: 1) Our insurance carrier refuses to defend <br />the City in the Dingess case. An action will be filed against the <br />insurance company. <br />2) The insurance company for Sister's Chicken has brought a lawsuit <br />because of a defect in a handicap ramp. Insurance comPanY was notified <br />that the City was inappropriately named and we asked for dismissal or <br />we would file an answer and. file a rule 11 asking for attorney's fees. <br />We mere dismissed out of the case. <br />3) A reply was received from plaintiff's counsel in Faughender case. <br />Case is briefed and ready to be argued in the Sixth Circuit. <br />Finance Director Burns reported: 1) Budget for 1991 is prepared and on <br />first reading tonight. The General Fund shows revenues of approximately <br />$10,860,000 and expenditures of $11,095,000; we would be left at the end <br />of 1991 with a fund balance of approximately $18,000. Relative to the <br />Sewer Borxl. Retirement Fund, because of large fiord balance carry over and <br />the negotiations with Fairview on the capital portion of their contract, <br />we were able to reduce the real estate taxes by approximately eight <br />tenths of a mill. <br />2) On July 11 at 7 p.m there will be a Public Hearing regarding the <br />budget. <br />Mr. McKay, Chairman Environmental Control Committee, reported: 1) West <br />Shore Solid Waste Conmiittee met on June 26. Proposals from the nine <br />firms who submitted plans for a recycling building were discussed. The <br />criteria in choosing one of the applicants will be: ability to pick up <br />all solid waste including compost; specific goal upon recycling; a <br />marketing plan for recycled material; a plan for the impact of the <br />operation on the environment. Applicants are being asked to submit a <br />resume pertaining to job development and management plan and to submit <br />information on their personnel's experience and operation of their <br />technology. The applicant should also be bonded. <br />Mr. Tallon, Chairman Finance Committee, reported: 1) The Finance <br />Committee met on Wednesday, June 27 to discuss Ordinances 90-82, 90-83, <br />90-84, 90-85 which pertain to purchases of/for Service Dept. equipment. <br />These ordinances are on second reading tonight; because of time <br />constraints in ordering, suspension of the rules will be asked. <br />2) Ordinance 90-88 is a transfer of appropriations for Civil Service <br />testing. Funds are needed to pay for Police Dept. physical <br />ex~m;nAtions. <br />3) Since North Olmsted is not having fireworks, the $1,.000 appropriated <br />for that item was used to defray the cost of Civil Service. <br />3) In regard to the sewer revenue item, there is a deficiency in the <br />carbon line item because we have to meet EPA standards. That line item <br />had to be increased by $60,000 for introduction of a synthetic carbon in <br />order to meet the EPA standards. We will ask for suspension of the <br />rules on this legislation, <br />Mr. O'Grady, Chairman of Public Safety, Health and Welfare Committee, <br />reported: 1) The Safety Committee met on Wednesday, June 27 to continue <br />discussion on Ordinance 90-80. Chief Sefcek told the committee that no <br />policemen have been added since 1977 and the past few years have seen a <br />five to ten percent increase in calls for service. Overtime has been <br />averaging $30,000 a year; this year through May it is already $20,000. <br />2 <br /> <br />
