Council Minutes of 5/1/90 <br />-2- <br />2) Flooding problems will be addressed at the May 15th meeting of council; has a <br />plan to address the flooding and the infiltration in the northeast quadrant of the <br />city. <br />3) This week, received a letter from the USEPA; they have accepted the Fairview <br />Park agreement which was approved by Fairview Park at their last council meeting. <br />Mayors Gaul and Boyle have signed and forwarded the legislation to USEPA in <br />Chicago as well as the Ohio EPA in both cities. Mr. Todd of USEPA stated: <br />your cooperation in this matter has served our mutual benefit and has been <br />appreciated. This puts an end to the issue which began at the beginning of <br />1990 when USEPA was looking for .$13,000,000 to be refunded from the grant. <br />4) Fireman Dave Meadows has been sworn in and brings the fire complement to <br />forty men, which was the complement approved by council earlier this year. <br />City has tested for civilian dispatchers to free up firemen now covering <br />this position; hopefully will be hiring from this list later on this month. <br />Law Director Gareau reported: 1) This week, attended a pretrial conference on <br />one of a number of Butera appeals. This one was an appeal from the Civil <br />Service Commission's dismissal of his appeal because he failed to file the <br />appeal in a timely fashion. The court has indicated they will simply decide <br />the matter on briefs already submitted. <br />2) Also, received notification from the State of Ohio with respect to a charge <br />brought by. Mr. Butera which indicated the city was discriminating aga3-nst him, because <br />he had previously brought a civil rights action, Mr. Butera claimed this was <br />"retaliation". The Civil Rights Commiission of the State of Ohio found there was <br />no justification for this charge and dismissed his charge of retaliation. <br />3) In the case of Collin versus the City of North Olmsted, where a person fell <br />in the street while bicycling, has not received the arbitrator's decision but <br />anticipates a response prior to the next council meeting. <br />In the absence of Finance Director Bupns, Mayor Boyle reported: 1) Oxi June 6th, <br />city will roll over the notes from last year. In this process, will be paying <br />off the $145,000 Deerfield note and pay down $30,000 on the judgment note; this <br />will still leave a balance at the end of the year. Hopefully, the reissuance <br />will bring it in line with the notes being proposed this evening so .that next <br />year, if the city decides to go for bonds, they will all be together and one <br />bond issue will lower expenses. May get back to council in November With a bond <br />issue. Bonding and borrowing in December is not a good idea since there is too <br />much fluctuation in the market because of everyone jockeying foz tax positions. <br />2) The Finance Department has also made up a list of vendors which can be compared <br />with the Regional Income Tax list to make sure the city is not payipg anyone wb,a <br />might then end up as a delinquent, This is one of the things a combined Q£fice <br />of Finance Director and Tax Administrator can accomplish. <br />Mr. McKay, Chairman Environmental Control Committee reported: 1) The Westshore <br />Solid Waste Advisory Committee met on Wednesday,. April-24th, at Rocky River <br />City Hall. Committee briefly reviewed proposals from nine companies to con- <br />struct and operate a municipal solid waste material recovery facility..
