<br />' Council Minutes of 4/17/90 -2- <br />6) CEI has advised that they will be doing engineering and evaluation of the <br />street lights on Lorain Road. There have been complaints about the lights being <br />dim from the Fairview border to the North Ridgeville border, especially on the <br />west side where they are very dim. City has requested that they evaluate changing <br />to a high pressure sodium light which gives a better light that is more concen- <br />trated. It is slightly more expensive by about $38 per lamp but because of the <br />greater intensity would probably require fewer lamps. <br />7) City is currently studying sewer bills and talking to the City of Cleveland <br />which does the billing for North Olmsted.. Have discussed changing the billing <br />to 500 MCF instead of 1,000 MCF; a lot of senior citizens don't reach that mini- <br />mum and are actually paying double costs because of the billing restrictions. <br />City is also looking to include capital charges so a maintenance program for <br />sewer lines can be implemented - the relining of sanitary laterals from houses <br />to the main sewer line which have been allowing a lot of infiltration. Would like <br />to establish such a maintenance program so it would not be a great burden on any- <br />body. It is not a special assessment type of burden; it is paid for as it is being <br />used. <br />Law Director Gareau reported: 1) Had previously informed council that the city had <br />prevailed in the Eliza Jennings Case and had obtained another $110,000 on the <br />Renaissance Project. The attornies for Eliza. Jennings had asked the Supreme Court <br />to reconsider its opinion; Law Director received notification this past week that <br />the Supreme Court refused to do so; that decision is now final. <br />2) A personal injury case will be tried next Monday on behalf of the City of North <br />Olmsted. <br />3) With respect to the three students who were struck by an automobile in front <br />of the Middle School, Law Director has received letters from two attornies <br />claiming that the City of North Olmsted is somehow liable. There was a mistake <br />in the original accident report. Somehow the attornies felt that the city failed <br />to have a school guard at the location. In checking, the city never had a school <br />guard there; furthermore, school had been out for an hour and five minutes prior <br />to the accident. Both attornies. have been notified and presumably this will end <br />their claims. <br />Mrs. Saringer, Chairman Building, Zoning and Development Committee reported: <br />1) BZD Committee met on April 4th with all members in attendance as well as <br />Building Commissioner Conway and Assistant Engineer McDermott. The following <br />items were discussed: <br />a. Darby O'Toole's, exterior renovation to building.. Committee <br />has no objection; in fact this renovation will be quite an improvement and has <br />been approved by Planning Commission and ARB as well as the BZD Committee. Moved <br />Council approve the Darby O'Toole's exterior renovation to building which includes <br />the plan showing eleven parking spaces to be landbanked, second by Mrs. Bahas, <br />unanimously approved. <br />b. With respect to Cherandon Plaze, no permits will be issued <br />until sanitary and storm sewers are constructed in conjunction with the Professional <br />Medical Building and until the retention system is approved by Engineering Depart- <br />ment and assembly plat is approved by Planning Commission. No action will be taken <br />by BZD Committee until the above items have been covered. <br />c. May Company, two additions; one, approximately 4,000 square <br />feet filling in an existing colonnade on the northern lower level; two, on the <br />south side with 23,000 square feet. Some parking will be .removed from Lorain <br />Road and landscaping will be relocated. Committee has no objection. Moved Council <br />approve the May Company additions, incorporating. suggest ions of Planning Commission <br />and ARB, second by Mr. Tallon, unanimously approved. <br />2) Noted that BZD Committee Meetings will be held on Wednesdays in the future. <br /> <br />
