<br />~ Council Minutes of 3/6/90 <br />-2- <br />4) Has received a report from the County Auditor with respect to new construction <br />in the 80's. City of North Olmsted ranked 12th in the county with $117,130,000 <br />in new construction out of the 5.3 billion dollars in new construction in the <br />county. City ranked 9th in commercial with $68,000,000 and in industrial with <br />$80,000. North Olmsted ranked 15th in the county on residential with $48,700,000 <br />in new residential construction. <br />5) 1990 marks the 200th anniversary of the United Stated Census Bureau and resi- <br />dents will be receiving their questionnaires in the near future. The census is <br />not just a question of the population of the nation or the division of the House <br />of Representatives, for which it was originally formed, but is the basis for a <br />lot of the state and federal funding. <br />6) 1990 is also the 175th birthday of North Olmsted; the year is known but not <br />a specific date - only that it was sometime in the summer of 1815. Homecoming <br />seems to be a good time to plan some activities to commemorate this important <br />event. A meeting will be held on Thursday, at 7:30 P.M., for anyone who would <br />like to participate in planning this celebration. Please call Mayor Boyle or <br />Nancy Wlodarsky if you are interested in attending this meeting which will be <br />held at City Hall. <br />Law Director Gareau reported: 1) Last Friday, a deposition was taken in one <br />of our. personal injury cases involving the bicyclist who had a fall on David Drive. <br />2) Another deposition was taken, on site, at the Wastewater Treatment Plant with <br />respect to another case which has been set for arbitration hearings. Attempts <br />to settle this matter by the Law Director have been unsuccessful. <br />3) Since the last council meeting, has received word that the Law Department was <br />successful in having the Court of Appeals' decision overturned by the Supreme <br />Court with regard to the Eliza Jennings' Case. This was a dispute over how much <br />money they owed the city for sewer tap-in fees. City calculated the amount to be <br />around $172,000; they contended it was only $60,000 and went to the Court of Appeals <br />on a declaratory judgment action asking the court to determine that they, in fact, <br />only did owe $60,000. Court of Appeals ruled in their favor; city appealed to <br />the Supreme Court and last week the Supreme Court reversed the Court of Appeals and <br />the city will now have $110,000 more in the Sewer Revenue Fund assuming that their <br />motion for reconsideration is not granted. <br />Mr. McKay, Chairman Environmental Control Committee reported: 1) West Shore Solid <br />Waste Management Committee met on February 21st at Rocky River City Hall to dis- <br />cuss the following: Lakewood has asked for bids to make a re-cycling center at the <br />site of the old incinerator on Berea Road. Bid opening will be on March 20th at <br />2 P.M. That same evening, the committee will review the bids. As this plan goes <br />forward, Lakewood is asking all six eommunitities to participate in the construction <br />and operation of the plant, financing for which would be each communitity's re- <br />sponsibility; each city's portion would be based on either a percentage basis or <br />on a per ton basis. <br />2) April 22nd has been designated as "Earth Day" in Ohio and committee recommends <br />that each city work on an educational program to reduce waste; will probably go <br />to the schools and hopefully will have something in the community. <br />Mr. Tallon, Chairman Finance Committee reported: 1) Finance Committee met on <br />March 5th, at 8 P.M., with all members present as well as President Boehmer, <br />Mayor Boyle, and Directors Burns, Bohlmann and Wilamosky. Committee reviewed <br />Ordinance No. 90-18, the appropriation ordinance, for any major discrepancies and <br />then by individual departments. Approximately three or four of the smaller de- <br />partments were discussed. Part of the meeting was taken up with the scheduling <br />of other meetings which were planned and will be announced under miscellaneous <br />business this evening. <br />
