<br />Council Minutes of 2/20/90 -2- <br />city-authorized medical examinations; b) prior claims, when increases or <br />continuences are requested, will be examined and probably challenged.; c) <br />Workmens Compensation Bureau will be requested to issue a separate list for <br />departments with high claim occurrences. This will make those departments <br />more accountable to the workmens' comp rate as well as to the employees' <br />safety. Both issues are important to the administration. <br />4) Visited Columbus last week with Director Wilamosky looking for money. Met <br />with former State Representative Colonna, several other state representatives <br />and state senators as well as the Director of Public Works. The good news is <br />that there is some money in Columbus; the bad news is that it is mostly wrapped <br />up in matching funds. North Olmsted can accommodate matching funds through <br />engineering - for instance $200,000 for engineering for Ccuntry Club in order <br />to receive the $2,000,000 required for reconstruction of this street. City <br />could easily list about $2,000,000 in engineering costs that it could incur <br />this .year which would, through matching funds, produce about $20,000,000 in <br />work but obviously this cannot be done - the city does not have that kind of <br />an appropriation. Will be meeting with the Finance Committee to decide what <br />programs can be accomplished. <br />5) While in Columbus, also testified on the Bingo Bill sponsored by State <br />Representative James Petro. This bill will allow Bingo for seniors, 60 years <br />old and above, for 25G a card and with the majority of the money being returned <br />to the winners so it could not be construed as a fund raiser but as dust pure <br />entertainment for seniors. Mr. Petro asked Mr. Colonna, who is sponsoring a <br />Bingo Bill pertaining to churches and fraternal organizations, to add his <br />bill for the seniors and Mr. Colonna agreed to do so. The bill now-has bi- <br />partisan sponsorship and passage could possibly take place by mid-year. <br />6) On the lighter side, the administration received a letter today from the <br />Citizens' State Bank advising that it is a finalist in the Readers Digest <br />Sweepstakes. Mayor Boyle will have to change his name to Mr. N. Olmsted but <br />$5,000,000 has been placed in the Citizens' State Bank in this name and at <br />a 28814 Lorain Avenue address - which happens to be Fire Station No. 1. This <br />should certainly clear up some of Chief Van Kuren's problems. <br />Law Director Gareau reported.: 1) City of North Olmsted presently has a claim <br />pending against it for an automobile accident involving a snow plow and a van. <br />State Farm Insurance filed a subrogation claim against the city for the damage <br />done by the snow plow, which they paid for; they seek to have the city re- <br />imburse them for this payment. The Municipal Tort Reform Act, adopted several <br />years ago, provides that the city is not required to reimburse an insurance <br />company on a subrogation claim. Various appellate districts, throughout the <br />State of Ohio, have either been declaring this section of the law unconstitutional <br />or declaring that it is constitutional. Today, the Supreme Court of the State of <br />Ohio issued its ruling on an issue and upheld the law. Consequently, expects the <br />law suit filed against the city last week to be withdrawn. <br />2) In small claims court this past week, sued Kellor's Jewelry for failure to <br />pay their false alarm fees in the amount of $200. <br />3) Has filed a brief in the Eighth Appellate District Court for the Private <br />Detective Case. <br />4) Attended the annual seminar for the Law Directors' Association yesterday. <br />Finance Director Burns reported: 1) As directed in Ordinance No. 89-81, the <br />Finance Department is notifying landlords of multi-family buildings that as <br />of January 1st, 1990, they are required to provide lists of their tenants. Is <br />also sending the same. letter to the owner's associations of condominiums asking <br />them to forward the notice to owners who lease out to tenants. Is allowing a <br />little more reporting time to ease the burden of their reporting and the paper- <br />work on their part. <br />~. r, _ . , _ . __~ _ ~;_~~~:~,~~ <br />
