,~,-. <br />Council Minutes of 1/2/90 -2- <br />Mayor Boyle contacted EPA today to discuss this with them and stated that the <br />~;,,~ issue related to the Fairview contract and the Fairview contract related to <br />;,,~ user charges. It did not relate to capital improvements which were a part of <br />the former contract and therefore the user charge contract should not be held <br />up because of that. It turned out that this was the stance of EPA and what <br />they had been trying to get across to North Olmsted but never had received a <br />response. Was unable to contact Mayor Gaul of Fairview Park today but did <br />leave a message to schedule a meeting and hopefully conclude the negotiations <br />on the user charges this month. Does not see any problem in getting this wrapped <br />up by the 16th with the exception of having to call a special meeting of council <br />to do so. City may not have to formally wrap this up before the end of the month <br />as long as EPA knows progress is being made and there is an agreement. <br />Law Director Gareau reported: 1) Since November, North Olmsted has had a draft <br />copy of the agreement with the City of Fairview Park; just have not had a meeting <br />scheduled. Hopefully, Mayors Boyle and Gaul will schedule a meeting in the near <br />future; the terms and conditions of the agreement will be discussed and the matter <br />will be resolved quickly since EPA has been pressing to have this completed. <br />2) The case involving the Maple Ridge cyclist. was settled for $2,500. <br />3) Will be getting up to full speed in working out the EPA matter with respect to <br />the tap-in ban. Hope to have a consolidated program with respect to presenting <br />EPA with a proposal to work on the .overloading of the sanitary sewer system and <br />will pass this on to the Attorney General's off ice. <br />Finance Director Burns reported: 1) Recent changes in Finance Department personnel <br />have created two vacancies, one of which has been filled and the other which will <br />be filled on January 8th. <br />Mr. Bohlmann, Chairman Intra-Governmental Relations and Legislation Committee re- <br />ported: 1) Moved council approve the re-appointment of Brian Gorris to the <br />Planning Commission for a term commencing January 2, 1990 through December 31, 1994, <br />second by Mrs. Bahas, unanimously approved. <br />Mr. O'Grady moved council have no objection to the transfer of a D5 liquor permit <br />from Lauren Properties, Incorporated, 2410fi Lorain Road, to Lauren Properties, <br />Incorporated and MID-APP, Incorporated, 25863 Great Northern. Shopping Center, <br />North Olmsted, Ohio, second by Mrs. Bahas, unanimously approved. <br />Letters and Communications: <br />Clerk announced receipt of letter from Yvonne Petrigac to Members of Council, ex- <br />plaining the purchase of a frame for her picture as well as one for former <br />Mayor Swietyniowski's picture which should be finished in a week or so. <br />LEGISLATION: <br />Ordinance No. 89-105 introduced by Councilman Tallon was given its second reading. <br />An ordinance vacating a portion of a sanitary sewer easement located on property <br />now owned by Romp Realty Company on the southeastern corner of Lorain and Columbia <br />Roads, and further, accepting an easement from Romp Realty Company for a relocated <br />sanitary sewer. <br />Ordinance No. 89-106 introduced by Mr. Wilamosky was given its second reading. An <br />ordinance establishing rates of compensation for various administrative and legis- <br />lative personnel, and declaring an emergency. Mr. O'Grady moved for suspension of <br />,. rule requiring three readings, second by Mr. Tallon. Roll call on motion: Affirma- <br />tive vote: O'Grady, Tallon, Wilamosky, McKay, Leonard, Bahas. Abstained: Bohlman. <br />6 Aye - 1 Abstention - Motion carried. <br /> <br />
