Council Minutes of 2/6/91 <br />Audience Participation .(.continued) <br />Commissioner, the work en ne in accordance with the Code; it would <br />be difficult to know that at some future date cracks would develop. <br />Since the builder is planning a new development in the City, the Building <br />Department will be asked to look into the methods used to pour the <br />basements. Members of Council and the Administration expressed concern for <br />the residents arxi proani.sed to do whatever they could to help. Ho~rever, it <br />was pointed out that the remedy for this situation is not with the City but <br />with the developer. <br />Mr. McKay asked the Law Director if the City could susperxi the developer's <br />building until it is determined what is going on. <br />Mr. Gareau replied that to do so, the City mould have to clearly show that <br />the person was violating some provision of the Codified Ordinances. He has <br />to be afforded procedural due process. Also, the problem could be with a <br />sub-contractor. The City would have to proceed very carefully in this <br />matter. <br />John Fairfield, 4126 Fielding Drive, congratulated City Council, the Mayor, <br />and the Administratioa~ on the passage of the insane tax. He also expressed <br />best wishes to Council Member Leonard who is recuperating fran surgery. <br />John VanKuren, 30888 Windy Hollow, said it had been a pleasure and a <br />privilege to serve the people of North Olmsted as Fire Chief. <br />Members of Scout Troop 204 were recognized: Bob McGreevey, Scout Master; <br />Kevin Roll, Senior Patrol Leader, Scott Jones; Chris McGreevey, and David <br />Jones. <br />Council President Boehzrier joined Council at 8:56 p.m. <br />LEGISLATION <br />Ordinance No. 90-174 introduced by Mr. Tallon was given its third reading. <br />An ordinance establishing a new and revised Chapter 943 of the Codified <br />Ordinances of the City of North Olmsted entitled "Cemeteries" as amended. <br />Mr. Nashar moved for adoption; second by Mr. McKay; passed unanimously. <br />Ordinance No. 90-174 adopted. <br />Ordinance No. 91-2 introduced by Mrs. Beringer was given its third reading. <br />An ordinance vacating a portion of a drainage easement located on properties <br />now owned by Thomas A. and Ruth E. Sloggett, Eric N. and Joan A. Reike, and <br />R.A.G. Custom Homes, Inc. and further accepting a drainage easement, as <br />delineated and noted in the Sloggett & Reike Resubdivision. Mrs. Beringer <br />moved for adoption; second by Mr. Tallon; passed unanimously. Ordinance No. <br />91-2 adopted. <br />Ordinance No. 91-5 introduced by Mr. Tallon was given its third reading. An <br />ordinance establishing and fixing the canpensation for the Counc].~n at <br />Large Members of the Council of the City of North Olmsted for the term of <br />office commencing January 1, 1992 aix3 ending December 31, 1995 and declaring <br />an emergency. Mr. Tallon moved for adoption; second by Mr. McKay; passed <br />t,nan;mously. Ordinance No. 91-5 adopted. <br />4 <br />
