Council Minutes of 11/17/92 <br />Township is required to go before the County Planning Co~.i.ssion for approval. <br />This then involves the County Sanitary Engineer who can approve if it is within <br />the limits of our contract with the Township. At that point, it comes to North <br />Olmsted for approval. If we do not have the capacity, we will stop the proposal. <br />In the past, we have had a tap-in ban on the Township. We have rerregatiated with <br />them on limits as recently as this summer. At this time, it is not known whether <br />we have the capacity for this within the contract. or whether the capacity is <br />available within the transmission lines. On the brighter side, it is interesting <br />to note that four years ago nobody wanted to use our sewers . The work on our <br />sewers is being recognized. We have not improved to the point where we can <br />acco~anodate all requests; everyone will have to follow the law aril the contract. <br />When we identify the amount of capacity available, then it will be on a first- <br />come first-served basis. <br />Law Director Gareau reported: 1) Along with Mayor Boyle and Finance Director <br />Burns, traveled to New York to make presentations to Moody' s aryd two insurance <br />companies with respect to the bond issues that are being sold later this month. <br />Hopefully, we should know very soon if our current A-1 bond rating will be <br />upheld. <br />2) Will attend a conference in the Court of Appeals next week on the Smith fire- <br />fighter case. The city won in the Supreme Court and it was remanded to the Court <br />of Appeals for further findings consistent with the city's vacation policy for <br />part-time employees. <br />3) We have received another false arrest lawsuit. This case has to do with an <br />arrest made as a result of a domestic violence complaint. The city has govern- <br />mental ~~m~ty is these cases, but the Police officers. do not. As reported at <br />the last meeting, the city had been dismissed out of another false arrest case. <br />Since that time, the Police officer has also been dismissed aut of that case. <br />Finance Director Burns reported: 1) Before Council today is Resolution 92-164 <br />which accepts the real estate tax rates for the county for the coming year 1993. <br />It includes the basic 11.1 mill .7 mills for the recreation levy, and 1.4 of <br />the 3 mills allowed for the sewer debt levy for a total of 13.2 mills. The rate <br />for 1992 was 13.3; however, the sewer debt millage has been dropped from 1.5 to <br />1.4 mills. <br />2) Resolution 92-169 requests authorization for RITA to deduct court and related <br />costs fran the disbursement of taxes that are made to North Olmsted. The city <br />has been able to get an allocation of civil cases with the Rocky River Municipal <br />court, and delinquent tax payers will be systematically submitted based on the <br />dollar amount owed. <br />3) Has been in contact with the Postmaster of North Olmsted who is being very <br />cooperative arxi supportive in the effort to make sure that all postal employees <br />file proper income tax returns with the city. One postal employee has made an <br />appointment to come in and settle up with the city. <br />4) As reported by Mr. Gateau, the city is trying to maintain our A-1 band. rating. <br />Moody's has looked at our financial numbers and seen that we basically have spent <br />down our funds and do not have significant carryovers--which they like to see. <br />In the presentations, it was explained that this has occurred because of the <br />city's efforts to cure the flooding problems and to fix the streets which were <br />3 <br /> <br />
