Council Minutes of 8/18/92 <br />3) Tomorrow morning, a hearing will be held in Common Pleas Court with regard to <br />the co~rplaint filed by Mares Funtime Pizza asking that the city ordinance <br />dealing with the charging of a licensing fee for video games be declared uncon- <br />stitutional. They have also asked that the prohibition on pinball games be <br />declared unconstitutional. Because Mares has xmt paid the fees, he has filed a <br />counter claim and asked for a preliminary injunction to clone the business dawn <br />until the fees are paid. It is unacceptable for therm to simply ignore cur <br />ordinance and to continwe to operate without a license. The $50 gamerocm fee and <br />$25 fee for each machine does not seem unreasonable. <br />4) Mr. Nashar asked if anything new had occurred with respect to the Eliza <br />Jennings case. Mr. Gareau replied that a brief is currently being prepared, but <br />nothing new has happened since the hearing before the Court of Appeals when Eliza <br />Jennings offered to pay 50X of what is owed. This offer was rejected; they <br />should pay aJ.l monies that are dive axxi owed. <br />Finance Director Burns reported: 1) Ordinance 92-90, a transfer ordinance on the <br />agenda, includes the transfer of funds from Van Driver to Van Operations. This <br />change is taking place because the senior vans will be operated out of a non- <br />profi.t organization as of September 1. The drivers will be Toyed by the North <br />Olmsted Commission on Paratransit and :not by the City of North Olmsted. The <br />non profit entity will bill the city and the other commnanities for use of the <br />paratransit facilities. <br />2) Ordinances 92-91 through 92-99 are rollover ordinances dealing with notes that <br />come due on September 4. These notes are scheduled to run until December 18, <br />which will tie them into existing notes and bring them into a single package. <br />Also, some of the notes will be brought together for a bonding, and we anticipate <br />paying off a good deal of these notes in December. The underwriter has <br />commitments to sell these notes at an interest rate of 3.17X. <br />4) Ordinance 92-108, which is on tonight's agenda, adopts the criteria, rules and <br />regulations for the interest subsidy program for name improvement loans. The <br />program will begin on September 15. The loans available through this program <br />will range from a minirrnm of $2,500 to a maximum of $25,000. The subsidy will be <br />the first 2~X of the interest rate. These loans will be available to Section 8 <br />law to moderate income households and to properties that are at least 10 years <br />old. <br />Mrs. Beringer, Chairperson of the Building, Zoning and Development Committee, <br />reported: 1) The BZD Com<mi.ttee met at 7:15 p.m. on August 18 to discuss <br />Ordinance No. 92-100. This is an approval of two dedication plats for Silverdale <br />and Duane Roads. Additional right-of-way is needed at Lorain, Silverdale and <br />Duane Roads for the improvement project. The committee had no objection. <br />Mr. Lind, Chairperson of the Finance Committee, reported: 1) The Finance <br />Committee met at 8:30 p.m. on Tuesday, August 11. Agenda items were: <br />a. Ordinance 92-90, which is a transfer ordinance. The committee recammetvd.s <br />passage. <br />b. Ordinances 92-91 through 92-99, which are note rollovers.
