Council Minutes of 4/21/92 <br />Mayor Boyle said that we do have an autoanatic mutual aid program. Mutual aid was <br />coming, but our squad was able to reach the home first. <br />Mrs. Saringer congratulated the Mayor and everyone who worked on securing the Moen <br />headquarters for North Olmsted. <br />Law Director Gareau reported: 1) We have received a decision in the Cater case, <br />which involved the suspension of Civil Service Commissioner Stroh. In essence, <br />the court decided that the suspension was proper. However, the court said the <br />discharge could not be affected by the City Council simply because some of the <br />members were appointed rather than elected. Mr. Stroh will be paid for the number <br />of meetings that remained during his term; the cost of the individual. who heard <br />the case will be shared; each party will pay their awn attorney's fees. The City <br />Charter has since been changed to include "members of Council" rather than <br />"elected members of Council." <br />2) We also received a decision i.n the case dealing with a firefighter who claimed <br />that the city had improperly changed hospitalization coverage. The city had <br />denied the grievance, aril the arbitrator has upheld that decision. <br />Finance Director Burns reported: 1) On first reading tonight are Ordinances 92-40, <br />92-41 and 92-42, which are is of prior note ordinances to change the due <br />dates from December 20, a Sunday, to December 18. <br />2) The city has received a pranissory note from Issue 2 fu~.s for the Silverdale/ <br />Selhurst project. The note is for approximately $272,000, has a zero interest <br />rate, and is payable over a 20-year period. After seeking the advice of legal <br />counsel, this note will require an ordinance, three readings and a 30-day waiting <br />period before it can be signed. Hopefully, the ordinance will be ready for <br />presentation at the next Council meeting. <br />Mr. McKay, Chairperson of the Enviroranental Control Committee, reported: 1) The <br />committee met on Tuesday, April 14. In attendance were Councilmen Leonard and <br />McKay, Safety Director Bohlmarin, and City Engineer Deichmann. Agenda items were <br />as follows: <br />a. Ordinance No. 92-35, which authorizes the Mayor to contract with Malcom <br />Pirnie Inc. for engineering services for a NPDES permit application for the <br />Wastewater Treatment Plant. The stormwater drainage system that serves the plant <br />requires a permit by the Ohio EPA. The area included is within one quarter of a <br />mile of the plant. Required for the permit is a site map which shows the drainage <br />features, drainage structures, tributary areas, building impervious areas and <br />receiving waters. Also, a test of the soil and run-off water is required. <br />Because Malcom Pirnie, Inc. is a highly-qualified company with experience at our <br />plant, the committee recommends approval of Ordinance 92-35. <br />b. Ordinance No. 92-37, which authorizes the Mayor to enter into a contract with <br />Browning-Ferris Industries of Ohio, Inc. for implementation of a recycling <br />program. Hopefully, the program will begin in May. Residents will be notified <br />through the mail and an education program at the schools. The cost of recycling <br />will be $1.81 per household, plus the cost of the regular pick-up. The cost for <br />the year will be $1,363,000. The committee recommends passage of Ordinance 92-37. <br />2 <br />
