<br />Council Minutes of 4/7/92 <br />currently attending a seminar in Indianapolis which also deals with economic <br />development. The main thrust of this seminar is regionalization and the potential <br />to use economic development for single-family housing rehabilitation. North <br />Olmsted, of course, has recently initiated such a program. <br />5) The construction season has begun, and orange barrels will soon be found around <br />the city. Some streets will necessarily be closed on a temrporary basis; the city <br />will inform residents and keep them up-to-date on any inconvenience. <br />6) The resolution authorizing a contract with Browning-Ferris Industries of Ohio <br />to implement a recycling program is before Council this evening. At the present <br />time, plans are to use two blue bags for recycling--one for newspapers and a <br />second for all other recyclables. BFI will notify single-family residents of the <br />start-up date aril will begin the educational process through our schools. Mult- <br />family dwellings and businesses are covered under their awn contracts anti the <br />recycling order on those contracts is handled by the County Plarning Commission. <br />The city is rat considering a charge for residents who do not recycle because the <br />response we have received from citizens indicates that North Olmsted residents <br />will be cooperative. <br />7) Norma Lingruen, secretary to the Police Chief, has recently retired. Norma has <br />been employed by the city for over 27 years and has been tree secretary to several <br />Chiefs. She has seen the development of this city and our safety forces through <br />the years, and she has been an asset to the city. Norma will certainly be missed. <br />8) This Sunday, April 12, the Rec Center will hold an open house for our first <br />annual bunny skate and Easter egg hunt. Marry activities have been planned for <br />children and adults alike--all are welcome to come and enjoy our recreational <br />facilities. <br />Mr. Nashar asked if the start-up date for recycling was the month of May. The <br />Mayor answered that the city is aiming to begin in May. He also explained that <br />the list of recyclables will be expanded in time. Also, it should be noted that <br />grass clippings will be picked up in the normal fashion as will leaves that are <br />bagged by residents. Mr. McKay stated that yard waste will not be permitted in <br />landfills. The Mayor agreed that this would be the law by the end of 1993. By <br />that time, BFI will have the facilities and equipment to convert the yard waste to <br />compost. <br />Law Director Gareau reported: 1) We gave oral argument. in the AFSCME case which <br />dates back to the early 1980's when the city converted to BFI for trash pickup. <br />The union originally asked for beck wages for 10 employees of $14,000. The city <br />had stipulated that the amount would be $7,000 should the court rule in favor of <br />AFSCME. A lower court did rule in favor of AFSCME; the Court of Appeals has <br />agreed with the arbitrator's ruling that these employees should have been called <br />back from layoff status even though the contract did not refer to them on a layoff <br />status. The case should not be taken to the Supreme Court because it deals with <br />the limited issue of the right to appeal an arbitration ruling. It is rec >ed <br />that the city pay the amount of $7,000 plus a limited amount of interest and put <br />an end to the issue. <br />2) With regard to the case dealing with cross connections of downspouts, we filed <br />a motion for summary judgment ar~d received a reply brief.
