Council Minutes of 12-07-2010 <br />~. <br />acted upon by Council. Usually this goes to other Boards and Commissions first <br />and then Council heazs the plan, so this situation is reversed. Council has to first <br />amend the preliminary plan before the Planning and Design Commission can <br />consider any of the detail development plan changes. This proposal is to amend <br />the preliminary land use plan to eliminate the office use component from <br />proposed Building "B". The approved plans show that Building B had a ground <br />floor retail with a second floor office component. The subject property is zoned <br />mixed-use D. This district was specifically created for this property in a <br />cooperative effort between the property owner and the city and with the assistance <br />of a planning consultant. The Boazd of Zoning Appeals approved a number of <br />deviations from the Code when the project was originally approved in 2004. <br />Some deviations included allowing a ratio of retail to office use of approximately <br />75% to 25%. The current request before Council would make the retail ratio <br />approximately 85%. The amendment failed 0-3. <br />Councilwoman Jones made a motion to hold North Olmsted Town Center amendment to <br />the preliminary plan in committee. The motion was seconded by Councilman Bazker. <br />Roll Call: Jones, no; Barker, no; Brossard, no; Williamson, no; Kearney, yes; Mahoney, <br />yes; Orlowski, yes. Motion to hold in committee fails 3-4. <br />Councilwoman Jones made a motion to approve the amendment to the preliminary plan <br />of North Olmsted Town Center. The motion was seconded by Councilman Barker. Roll <br />Call: Jones, no; Barker, no; Kearney, yes; Mahoney, yes; Brossazd, no; Williamson, no; <br />Orlowski, yes. Motion to approve the amendment fails 3-4. <br />• CMS 10-24 Clearwire located at 4930 Dover Center Road -This proposal <br />installing three wireless communication antennas and three microwave dishes on <br />the existing water tower. The water tower is owned by the City of Cleveland, but <br />the property is owned by the City of North Olmsted. The committee voted 3-0 for <br />approval. <br />Councilwoman Jones made a motion to approve CMS 10-24 Clearwire located at 4930 <br />Dover Center Road including the recommendations made by the Boards and <br />Commissions. The motion was seconded by Councilman Mahoney and passed <br />unanimously. CMS 10-24 Clearwire approved. <br />Councilman Mahoney, Chairman of the Public Safety, Health & Welfare Committee: <br />The Public Safety, Health & Welfare Committee met Tuesday, November 23, 2010 at <br />7:15 p.m. Present were committee members Mahoney, Kearney and Williamson; <br />Council President Limpert; and Director of Safety and Service Ritenauer. <br />• Discussed first was Liquor Permit transfer from Revco Discount Drug Center, <br />Inc. to Ohio CVS Stores LLC located at 23351 Lorain Road. The North Olmsted <br />Police Dept. conducted a background investigation and found nothing that would <br />cause an objection to this transfer. <br />5 <br />
