~r;s <br />Council Minutes of 11-16-2010 <br />Maureen Shear, 5646 Canterbury Road requested that a bridge be installed along the <br />Butternut Ridge I-480 overpass. She submitted pictures and a letter for the city's review. <br />The Mayor said he would discuss the issue with the Director of Safety/Service. <br />Jim Burns, 28938 Lorain Road referenced Ordinance 2010-100. He believes one of the <br />problems with this Ordinance is that most occupancy permits are issued to tenants, and <br />the tenants cannot do anything to make the landlord pay taxes. Without the tenant renting <br />space and paying landlords, the landlords cannot collect money to pay the real estate <br />taxes that the city is looking for. Additionally the employees will be unable to work, so <br />the city won't be able to collect income tax. If tenants invest money in their space <br />improvements and they're denied an occupancy permit, they are being penalized by not <br />being able to use their investment because of something a third party has done that they <br />have no control over. <br />LEGISLATION <br />Ordinance 2010-112 introduced by Mayor Kennedy and Council members Barker and <br />Jones was given its third reading. An Ordinance amending Section 1139.01 of the <br />Zoning Code of the City of North Olmsted to permit entertainment device arcades in <br />general retail zoning district, subject to conditional use permit and additional area <br />restrictions, as amended. Councilwoman Jones moved for adoption. The motion was <br />seconded by Councilman Barker and passed unanimously. Ordinance 2010-112 adopted. <br />Ordinance 2010-100 introduced by Mayor Kennedy was given its second reading. An <br />Ordinance amending Section 1119.02 of the Zoning Code of the City of North Olmsted <br />to require, as a prerequisite to issuance of certificate of occupancy, payment of or <br />agreement to make payments on real property taxes, as amended. <br />Ordinance 2010-136 introduced by Mayor Kennedy was given its second reading. An <br />Ordinance to make and transfer appropriations for current expenses and other <br />expenditures for the City of North Olmsted for the year ending December 31, 2010. <br />Councilman Barker made a motion to suspend the rule requiring three readings. The <br />motion was seconded by Councilwoman Jones and passed unanimously. Councilman <br />Barker moved for adoption. The motion was seconded by Councilwoman Jones and <br />passed unanimously. Ordinance 2010-136 adopted. <br />Resolution 2010-137 introduced by Mayor Kennedy was given its second reading. A <br />Resolution authorizing the Director of Public Service to advertise for bids for the <br />purchase of 5,000 tons of stone for various Service Department needs throughout the city <br />as detailed in the specifications on file, further authorizing the Mayor to enter into a <br />contract with the lowest and best bidder to purchase said stone, after Board of Control <br />approval, and declaring an emergency. Councilman Barker made a motion to suspend <br />the rule requiring three readings. The motion was seconded by Councilman Mahoney <br />and passed unanimously. Councilman Barker moved for adoption.
