Councilwoman Jones, Chairwoman of the BZD Committee: The BZD Committee met Tuesday, September 14, 2010 at 7:30p.m. Present were committee members Jones, Mahoney and Barker; Council President Limpert; Council members Brossard, Kearney, Orlowski, and Williamson; Mayor Kennedy; Director of Law Gareau; and Director of Planning and Development Wenger. • Discussed was CMS 10-30 M3 Realty, LLC located at 28595 Lorain Road. This proposal exists of building modifications to the existing building at this location. The applicant proposes to amend their 2009 plans as it relates to the building elevations only. The committee voted 3-0 for approval. Councilwoman Jones made a motion to approve CMS10-30 M3 Realty, LLC located at 28595 Lorain Road. The motion was seconded by Councilman Barker and passed unanimously. CMS10-30 M3 Realty, LLC approved. • Also discussed was Ordinance 2010-111 an Ordinance enacting a new Chapter of the Codified Ordinances of the City of North Olmsted, entitled "Entertainment Device Arcades," to provide for regulation and licensing, and declaring an emergency. Earlier this year, Council placed a moratorium on Internet cybercafes within the City of North Olmsted which will possibly be extended. The Law Dept. has thoroughly reviewed the matter, and there will be amendments to this Ordinance. No variances will be granted for these types of establishments, and fees will be reviewed by the administration and are consistent with other municipalities. The committee voted 3-0 to amend and approve Ordinance 2010- 111 with suspension. Councilwoman Jones made a motion to amend Ordinance 2010-111 as discussed in committee. The motion was seconded by Councilman Barker and passed unanimously. Ordinance 2010-111 amended. Councilwoman Williamson, Vice Chair of the Public Safety, Health & Welfare Committee: The Safety Committee met on Tuesday, September 14 2010 at 8:00 p.m. Present were Committee members Mahoney, Kearney and Williamson; Council members Barker, Brossard, Orlowski and Jones; Council President Limpert; Mayor Kennedy; Director of Law Gareau; Animal Warden and guests. • Liquor permit application no. 1070600 for Buckeye Barbecue, LLC dba Famous Dawes at 26410 Great Northern Shopping Center. The North Olmsted Police Dept. conducted a background check and found no issues with this applicant. The committee voted 3-0 to not object to the permit. 4
