Council Minutes of 07-20-2010 <br /> <br />Commander of VFW Post 7647, Pat Straley; President of the Ladies Auxiliary <br />and Ann Griss, Treasurer of the Ladies Auxiliary. The applicant brought forth a <br />rough draft of the proposed tent, seating and serving areas. The men's and <br />women's auxiliary will be serving beverages as well as regular bartenders from <br />the organization. Draft beer is the only alcoholic beverage that will be sold <br />during this event. A member of the organization has arranged for the use of a <br />beer truck whereby the beer will be dispensed from only one side of the truck <br />which abuts the tent. The truck will be fenced off as well as the tent. The <br />applicant stated that identification will be checked by volunteers of the men's <br />auxiliary, one of whom currently serves as a corrections officer. The sale of <br />beverages will not open until later in the day on Thursday and Friday, and may <br />possibly open at noon on Saturday. Sales will conclude one hour before the <br />Homecoming events close for the evening. Pull tab instant bingo will not be sold <br />at this stand. Councilman Barker expressed concerns that Ordinance 2010-79 <br />encompasses two separate matters that should be addressed individually with both <br />the sale of alcoholic beverages during Homecoming as well as alcoholic sales at <br />the Community Cabin. Gareau stated that there is nothing in the present <br />Ordinance that would prevent more than one beer vendor at a time during to <br />Homecoming event. In order for more than one permit to be issued, the city <br />would need to put that in an ordinance. Councilman Orlowski would like to see <br />only one vendor permitted to sell beer only in the park, and would also like to see <br />a non-profit agency running the booth. Councilwoman Jones said she does not <br />see it as Council's decision.to determine who will be selling alcoholic beverages <br />in the park, but rather the type of alcohol that would be permitted for consumption <br />within the Community Cabin. The Ordinance needs to be refined to set <br />limitations such as being allowed to consume beverages in the surrounding <br />perimeters of the Cabin. The meeting was open for public comment, and several <br />of the comments made were either for or against the sale of alcohol on city <br />property. It was recommended by several members of Council to make 2010-79 <br />two separate pieces of legislation to allow for the sale of alcohol in the park <br />during Homecoming and the regulation of alcohol sales on city property. <br />Ordinance 2010-79 will be amended to reflect the sale of alcoholic beverages at <br />the North Olmsted Homecoming festivities, and a new ordinance will be <br />introduced to address the issue of alcohol consumption on City property, such as <br />the Community Cabin. The law director will make the appropriate amendments <br />and will introduce the new legislation at a later date. <br />Councilwoman Williamson made a motion to amend Ordinance 2010-79. The motion <br />was seconded by Councilman Orlowski and passed unanimously. Ordinance 2010-79 <br />amended. <br />• The second item on the agenda for the evening was the issuance of a liquor permit <br />for Basalath, Inc., dba Flavors of India located at 26703 Brookpark Road <br />Extension, in North Olmsted. After review from Lt. Cox at the Police Dept. and <br />seeing no issues with the applicant, the committee recommended to issue the <br />liquor permit 2-0.
