Council reviewed the conditions of the city's conditional use permit procedure and heard from the Law Director. Councilwoman Jones stated the applicant did not meet the general criteria for a conditional use, specifically letter (c) that the proposed use would not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the district. Councilman Mahoney made a motion to recommend approval of a one-year conditional use permit for Elevate North. The motion was seconded by Councilwoman Jones and it failed 2- 1. The meeting adjourned at 7:26 p.m. Councilwoman Jones made a motion to approve the conditional use permit for CMS 10- 06 for Elevate North to locate as Westfield Great Northern Mall for aone-year time period. The motion was seconded by Councilman Mahoney. Roll Call: Jones, no; Mahoney, yes; Brossard, no; Barker, yes with comment. This is a very difficult vote for me, but because of the guidance from the Law Director and First Amendment issues - although I'm not happy with this - my vote is yes. Roll Call continued: Williamson, no; Orlowski, yes; President Limpert, yes. CMS 10-06 Elevate North Church approved 4-3. Councilman Mahoney, Vice Chairman of the Building, Zoning and Development Committee: The BZD Committee continued its meeting at 7:45 p.m. on Tuesday, April 27, 2010. • 2010-50 is an Ordinance amending Sections 1373.01 and 1373.02 of Chapter 1373 of the Building Code, entitled "Building, Zoning, Property Maintenance and other Nuisance Activities," in order to provide for the abatement of public nuisances and the recovery of city response costs incurred as the result of the multiple recurrence of such nuisance activities on commercial property located in the City of North Olmsted. Councilman Orlowski explained the purposes and legislative intent of his ordinance. Councilman Mahoney, at Councilman Orlowski's request, made a motion to hold Ordinance 2010-50 in committee. The motion was seconded by Councilman Barker, and passed 2-0 to hold in committee. The purpose of holding this Ordinance in committee is so that his colleagues can review it and offer their input at a later point in time. The meeting adjourned at 8 p.m. Councilwoman Jones thanked Council members and members of the city Administration who attended the RPI meeting held last week.
