<br />Council Minutes of 04-20-2010 <br />concerned, anybody could have sent that. Barrett said this reflects on the residents also. <br />Kennedy said the memo addresses that. <br />Jay Piatak, 23853 David Drive said on April 6, 2010 he and 2 other owners were granted <br />a meeting with the Safety Director, Building Commissioner and inspector in regazds to <br />the balconies at North Woods. He presented photographs and written documentation that <br />supported their contention that the balconies were being built improperly and with <br />materials that were compromising the safety of the balcony. The balcony above him has <br />one joist hanger fastened to a block of wood; it's a loose block. He would like to see the <br />inspection report that would allow this. During the meeting the Safety Director asked the <br />inspector if he's done any inspections since the project began. He said yes. How can two <br />thirds of a nail allow to be cut off and joist hangers literally cut in half and allowed to <br />remain and the inspector state he did not see any of this based on the plans that were <br />approved by the city? How can the city's Plans Examiner approve the plan and the city <br />allowed to be compromised? Piatak said he has two photographs of a board member's <br />balcony -one before showing the rotten wood and one after repairs showing four sistered <br />rotten joists which was the total number of joists on the balcony. How can an inspection <br />report state there are no sistered joists on this balcony when there is photographic <br />evidence of all four. The Safety Director said that if the city came out and inspected the <br />balconies and any of what they show in the photographs was true, the owner of the <br />balcony would be cited by the city. How can an owner be held responsible for <br />questionable repair of their balcony? They were told that condo law is not in the city's <br />jurisdiction. There are serious building code questions they have not received sufficient <br />answers to. Mayor Kennedy said he will address this first thing in the morning and he <br />will get Piatak written answers to his questions. <br />Harvey Fisher, 23875 Unit 106 and 205 said he is the owner of two condominiums at the <br />North Woods condos. He appreciates being allowed to speak at the meeting that Jay was <br />at also on April 6. He also submitted photographic documentation and voiced his <br />concerns. Ohio Building Code states in 106.7.1 "the materials, equipment or components <br />shall be designed and installed in accordance with the manufacturer's installation <br />instructions". At the meeting he was told that an azchitect or engineer's seal and <br />signature trumps the Ohio Building Code. If that was the case, there wouldn't be any <br />need for a building department. There are twenty-seven unanswered questions that need <br />to be answered. Most of them have to do with safety as it relates to the choice of <br />materials and use of assemblies on the project. Wood that is forty-seven years old rots <br />from getting wet and dry. He replaced his balcony in 1977 because the wood was rotted. <br />In October 31, 1981, the Board President at that time stated in the North Woods <br />newsletter that he found out through a contractor that they had termites and rotten wood <br />which affected the structural members and caused them to be weaker. The four page <br />state of Ohio disclosure form used when a home is going to be sold lists a lot of defects <br />including rotten termite damage. In September 2008, an engineer's report revealed rotten <br />wood in some of the balconies. This should have been removed and affects the value of <br />the condos. If this rotten wood was identified in 1981 and has gone through wet dry <br />cycles since then, he doesn't think it has become any better. The decks are connected <br />with forty-seven year old rotten, deteriorated wood. Councilman Kearney asked if these <br />10 <br />~~~... , . <br />.~.,..xy. _...: ~d , ., <br />
