Council Minutes of 04-20-2010 <br />building will be used as a showroom, offices and a vehicle service area. Building <br />modifications include refacing the building with limestone cladding, a new <br />cornice detail, and new glass and stainless awnings. The rear of the building will <br />be modified for a service ramp and the east elevation will include new service and <br />overhead doors. Changes to the western portion of the site include building out <br />some of the previously approved land banked parking along the west property line <br />nearest the street and removing a bump out to provide additional parking in the <br />front of the building. The eastern property will be used primarily for vehicle <br />storage and green space. Landscaping will be redesigned across the entire <br />frontage to compliment the plantings which have been installed at Mercedes, <br />Porsche and Saab across the street. Several existing trees will be preserved in the <br />front yard setback to the east of the new proposed driveway. Brick pavers will be <br />installed in the right-of--way area. Variances were granted by the BZA for vehicle <br />display parking in the front setback and building encroachment in the front <br />setback. This property has a unique situation of containing a flood zone area that <br />is subject to the City's wetland and riparian setback regulations contained in <br />Chapter 926 of the Codified Ordinances. This chapter prohibits the disturbance or <br />development of this delineated area. In this case, the applicant proposes to utilize <br />the flood zone area for storm water storage and pave a small area closest to the <br />building in order to allow for internal vehicle circulation. In addition to those to <br />be removed in the proposed parking field, ten trees will be removed to <br />accommodate the storm water system in the green space area; thirteen trees are <br />proposed to be planted. Proposals to disturb or develop the area must obtain a <br />variance from Chapter 926; unlike zoning issues where the Board of Zoning <br />Appeals can approve variances, only City Council can authorize a variance from <br />Chapter 926. The City Engineer then gave his report and detailed the variances <br />requested and his recommended conditions of approval, including a few updated <br />conditions which were detailed and submitted to the BZD committee under <br />another memo dated April 16, 2010. Councilwoman Jones made a motion to <br />recommend approval of the variances contained in the City Engineer's report <br />dated March 16 with the additional variances that the applicant need not provide <br />permeable pavement, and that the applicant will provide additional storm water <br />storage in the setback through greater excavation. Councilman Mahoney <br />seconded the motion and it passed 3-0. Councilman Barker made a motion to <br />approve the development proposal including the variances granted and the Boards <br />and Commissions recommendations. Councilman Mahoney seconded the motion <br />and it passed 3-0. The meeting adjourned at 8:06 p.m. <br />Councilwoman Jones made a motion to approve the variances detailed in the City <br />Engineer's report dated April 16, 2010 with and additional variance to Chapter 926.08(c) <br />to allow the city to accept a conservation easement for the green space. The motion was <br />seconded by Councilman Barker and passed unanimously.
