~~ <br />Council Minutes of 03-16-2010 <br />Law Director Gareau: <br />• He gave an update on property maintenance issues that have been before the <br />Court through the Law Department. In February and March, there were four <br />sentences imposed on property maintenance cases. There were four additional <br />cases in which they have accepted pleas on which remain for sentencing. Four <br />more are pending in the Law Department pending referrals from the Building <br />Department. <br />• Since he last reported regarding the Vivanni Family Trust (Stearns and Lorain <br />Plaza), the defendant was required to perform various activities which were done. <br />Front gutters and downspouts were replaced and repaired. There is another list of <br />significant items which will be performed now that the weather is turning more <br />favorable. The list includes the parking area light poles, rear gutters and painting. <br />That list is due for completion by May 20, 2010. <br />• Today the Law Department and Assistant Director of Law, Carole Heyward, put <br />on a presentation to Safety, Building and Planning concerning real property <br />maintenance strategies. Discussion included strategic target enforcement in <br />troubled neighborhoods, choice of law, criminal enforcement generally and <br />potential changes to streamline enforcement of nuisance abatement in the local <br />code. The Law Department has assembled a "top ten" list of housing and <br />strategies in government initiatives that they think will be helpful to the City of <br />North Olmsted. It will be presented to the Administration for their consideration. <br />• Pending litigation - Bertalan vs. Marvin Stotz and the City of North Olmsted. <br />This was accident involving a NOCOP vehicle. There is a settlement conference <br />scheduled for April 21, 2010. The matter remains set for trial on June 3, 2010. <br />• An unfair labor practice was filed by AFSCME Clerical/Technical concerning <br />matters at the Waste Water Treatment Plant. He and his staff are preparing a <br />response which is due March 27, 2010. <br />• He is currently doing a re-write of the rules and regulations for the Board of <br />Zoning Appeals to attempt to streamline the process and make it more efficient. <br />• The Mayor has asked him to review revenue generating contracts. There is a <br />desire on the part of the Administration to revisit the issue of advertising at the <br />Recreation Center as away to generate revenue. There may be some <br />recommended changes by way of legislation that could allow greater flexibility in <br />how they do that particular type of contract. <br />• He is currently in negotiation with AT&T concerning the lease for the monopole <br />at Clague Park. They seek to increase the height of the pole from 120 feet to 130 <br />feet. The Administration is looking into the possibility of using that tower to <br />handle police and fire communications which are currently sited at the Westbury <br />Complex. It's hoped that the tower, if it can be modified to meet the city's needs, <br />can help with cost savings. They had discussion today with AT&T on the <br />whether or not it's feasible to get additional height and to use it for safety <br />communications. <br />• The Fair Housing Review Board, Mayor Kennedy and the Law Department are <br />sponsoring a poster contest for children in the city of North Olmsted to celebrate <br />3 <br /> <br />
