Council Minutes of 02-16-10 <br />Councilwoman Williamson made a motion to suspend the rule requiring three readings as <br />the legislation was heard in committee, reviewed and recommended by the Charter <br />Review Commission. The motion was seconded by Councilman Kearney and passed <br />unanimously. <br />Dennis Lambert 25057 Carey Lane said he doesn't think there is anything wrong with the <br />decision to possibly make the city more efficient. But, what's important to recognize is <br />the Charter was originally formed by an elected Charter Commission. Those were people <br />voted on by the people of the city to put together a Charter. Evidently, those people felt <br />that there was a good reason to have these Departments of Safety and Department of <br />Service added to the Charter. He would tend to guess that their reasoning was it was a <br />safety net to the Mayor. This is a community that depends on services and safety to be <br />performed with their tax dollars. He's going to second guess what they were thinking, <br />but he would believe that they felt that politics could enter into a situation in the future <br />whether may or may not be one of Council choosing, and Council could - holding the <br />purse strings -withhold funding to fill positions that the Mayor may need to have filled <br />so that we have good engineering, good safety, and good things done that all these <br />department heads would do. This concept was not discussed at the Charter Review <br />Commission meeting. The Charter lives long on beyond Mayors and Council. He's not <br />so sure that the ~ obliteration of departments is really the answer. Perhaps some <br />modification to the Charter giving the Mayor more discretion in how he appoints these <br />things or whether he chooses to fill them or not fill them could have been added to the <br />Charter while maintaining those positions. <br />Councilwoman Williamson moved for adoption. The motion was seconded by <br />Councilwoman Jones and passed unanimously. Ordinance 2010-12 adopted. <br />Ordinance 2010-20 introduced by Mayor Kennedy was given its second reading. An <br />Ordinance amending Section 1701.27 of the Fire Prevention Code in order to create an <br />additional exemption to monetary charges assessed for false fire alarms and to authorize <br />the Director of Public Safety to grant or deny an exemption upon request. <br />Resolution 2010-21 was introduced and placed on first reading by Mayor Kennedy. A <br />Resolution authorizing the Mayor to enter into aone-year renewal of the Equitable <br />Sharing Agreement with the United States Departments of Justice and Treasury to <br />provide for transfer of cash or property seized and forfeited in connection with criminal <br />prosecution and declaring an emergency. Councilman Mahoney made a motion to <br />suspend the rule requiring three readings and formal committee review as per the Safety <br />Director, applications should be submitted no later than February 28, 2010 and so there's <br />a timeliness issue with this particular Resolution. The motion was seconded by <br />Councilman Kearney and passed unanimously. Councilman Mahoney moved for <br />adoption.
