If those <br />responsibilities are not done in-house, it should be charged to the Law Dept. as the cost of <br />doing legal business for the city. Mayor Kennedy said with all due respect, it is the <br />Mayor's decision to do that and my decision is to hire Johnson, Miller & Schmitz. <br />Copfer said there are professional negotiators that are not attorneys so should that be <br />charged to the Law Dept? Lambert said his opinion is that it should be charged to the <br />Law Dept. as this is a legal function. <br />Erik Phillips, 5676 Allendale Drive said he has met with Councilman Orlowski several <br />times regarding the asphalt overlay of Allendale Drive and Carey Lane. When he bought <br />his house, he was given notice by the Building Dept. that his driveway and sidewalk were <br />in disrepair and needed to be replaced. He had a new concrete driveway put in at that <br />time which is now partially under asphalt. He wants to know why asphalt is permitted to <br />be put on top of the driveway. There is a soft shoulder placed near a substantial berm <br />because none of the old material from the street was removed. They just added on top of <br />it. There will be tons of loose grindings going into the storm system which will cause <br />back-ups. He also requested that the broken and hanging limbs caused by large trucks in <br />the neighborhood be removed. Mayor Kennedy said the work that was done with the <br />berm was what ODOT recommends. The other option was to not have anything there. <br />The engineer has been out on the street and some of the catch basins will be raised. <br />Councilman Orlowski said to the Mayor that he has taken a look at the information <br />provided by the City Engineer. It talks about a maximum slope of 6 to 1. If you take a <br />look at 907-1 reference section 907.22, "every overlay shoulder treatment" it's not even <br />remotely similar to what the city has over on Allendale. By raising the grade on the road, <br />you've increased the height of the road away from what little surface there is for a berm. <br />He asked the Mayor to reconsider this because the slope is tremendous compared to what <br />the drawing shows. <br />LEGISLATION <br />Resolution 2011-91 introduced by Mayor Kennedy was given its third reading. A <br />Resolution authorizing the Director of Human Resources to solicit proposals to purchase <br />excess insurance coverage for the City Health Care & Hospitalization Plans for 2012, and <br />further authorizing the Mayor, subject to approval of the Board of Control, to enter into a <br />contract for said services and insurance. Councilman Barker moved for adoption. The <br />motion was seconded by Councilman Kearney and passed unanimously. Resolution <br />2011-91 adopted. <br />Ordinance 2011-93 introduced by Mayor Kennedy was given its third reading. An <br />Ordinance amending and re-establishing Chapter 1369 of the Building Code entitled <br />"Fences and Screen Walls" in order to change substantive standards and update <br />procedures.
