Council Minutes of 09-06-2011 <br />Director of Law Gareau: <br />• He updated Council on a civil matter from 2006 regarding an arbitrator's award to <br />the Fire Dept. in October 2006. A motion to dismiss has been pending. Last <br />action was a status conference held on March 30, 2009. <br />• Atrial is scheduled for November 2011 for the case of Megan Frenz vs. <br />Springvale Golf Course and Ballroom. <br />• False fire alarm cases have also been entered for the following: H&M, <br />Candlewood Suites, Westbury Towers and Olmsted Manor. <br />• The only other case pending is Eugene Dzambasow vs. Brian Bielozer, et al., an <br />excessive force case set for a conference hearing on October 13, 2011. <br />• There are two property maintenance convictions pending sentencing, five cases <br />are open subject to conviction, and two referrals have been made to the Law Dept. <br />Director of Finance Copfer: <br />• The Auditor of State released the Comprehensive Annual Financial Report <br />(C.A.F.R.) on Thursday, August 25, 2011 and it is available on their website as <br />well as the City of North Olmsted's website. <br />• She has compiled the information necessary for the annual information filing and <br />continuing disclosure requirements. <br />• The Ohio Tax Commissioner testified regarding the Budget Bill, and he <br />mentioned that the State is considering taking control of municipal income tax <br />collections and they would like to see more shared services. The City of North <br />Olmsted is part of R.I.T.A. so the city feels they are meeting that goal. R.I.T.A. <br />and the Ohio Municipal League will keep the city informed. <br />• She assisted with Hazen & Sawyer's report narrative supporting the sewer rate <br />increases starting in 2012. A final draft is expected tomorrow and will be <br />forwarded to Squires, Sanders & Dempsey who will draft the legislation. <br />Council President Limpert, Chairman of the Committee of the Whole: <br />The Committee of the Whole met Tuesday, August 23, 2011 at 8:00 p.m. Present were <br />Council President Limpert, all members of Council, Mayor Kennedy, Finance Director <br />Copfer and Safety/Service Director Thomas. <br />• The purpose of the meeting was to review the current status of refuse pick-up, <br />ordinances and policies. Key points were that new automated pick-up has made <br />the current ordinances obsolete. There are also inconsistencies as to where the <br />city provides garbage pick-up and type of pick-up. The Administration will be <br />bringing proposals to correct these issues to Council at a future meeting. <br />The Committee of the Whole met Tuesday, September 6, 2011 at 7:00 p.m. Present were <br />Council President Limpert, all members of Council, Law Director Gareau and Bob Dykes <br />from Triad Research. <br />2 <br />
