Public Works Commissioner <br />Ritenauer is currently working on a comprehensive plan. <br />LEGISLATION <br />Ordinance 2010-100 introduced by Mayor Kennedy was given its third reading. An <br />Ordinance amending Section 1119.02 of the Zoning Code of the City of North Olmsted <br />to require, as a prerequisite to issuance of certificate of occupancy, payment of or <br />agreement to make payments on real property taxes, as twice amended. Councilman <br />Barker moved for adoption. The motion was seconded by Councilman Mahoney. Roll <br />Call: Barker, yes; Mahoney, yes with comment in regards to Mr. Burn's thoughts which <br />he expressed very well. My bottom line is the possibility of a lawsuit has been discussed <br />with our fine Law Director, Mr. Gareau. He drafted legislation that Ibelieve -while <br />maybe not insulating us from lawsuits - I don't know that that's a major concern that I <br />have. Lastly, requiring anybody to pay their taxes before they can open shop just seems <br />to be common sense. Pay your taxes or, at a minimum, agree to pay your taxes before <br />you get your certificate of occupancy. So, my vote is yes for those primary reasons. Ordinance 2010-100 adopted. <br />Resolution 2011-68 introduced by Mayor Kennedy was given its third reading. A <br />Resolution authorizing the Mayor to enter into a renewed one-year contract with LK <br />Heating & Cooling, Inc. with a city option for an additional one year term, to perform <br />maintenance services upon the heating and cooling equipment at various city buildings, <br />and declaring an emergency. Councilman Kearney moved for adoption. The motion was <br />seconded by Councilman Mahoney. Roll Call: Kearney, yes; Mahoney, yes; Orlowski, <br />no; Barker, yes; Williamson, yes; Brossard, yes; Schumann, yes. Resolution 2011-6$ <br />adopted 6-1. <br />Ordinance 2011-54 introduced by Mayor Kennedy was given its second reading. An <br />Ordinance amending and restating Section 1345.05 of the Codified Ordinances of the <br />City of North Olmsted entitled "Standards for Residential Pools" in order to incorporate <br />the 2006 International Residential Code standards for residential pools, and declaring an <br />emergency. Councilman Mahoney made a motion, pursuant to Rule 48, to substitute the <br />Ordinance before Council rather than do an amended version of the prior Ordinance. The <br />motion was seconded by Councilman Kearney and passed unanimously. Ordinance <br />2011-54 approved as substitute legislation. <br />Resolution 2011-70 introduced by Mayor Kennedy was given its second reading. A <br />Resolution authorizing the Mayor to request proposals from firms qualified to conduct a <br />comprehensive curbside leaf collection program; further authorizing the Mayor to enter <br />into an agreement with the firm selected in the RFP process, after approval by the Board <br />of Control, and declaring an emergency.
