t <br />'x.,.. <br />Council Minutes of 06-07-2011 <br />• The outdoor pool will open on Tuesday, June 7, 2011. New improvements <br />include basketball hoops, removal of unsightly flowerbeds and the repair and <br />painting of benches around the deck. <br />• Ice rink repairs are in progress and going well. They will start to build the ice at <br />the end of the week and will be ready to open for summer programming on June <br />20, 2011. The pool dehumidification system bid has been advertised and will <br />close June 28, 2011. Summer camp starts next week with 205 registered and paid <br />participants. <br />• The Springvale parking lot improvement project is progressing quickly. While <br />the light fixtures to be installed will not be in for a couple of weeks, the lot itself <br />should be paved and marked within the next week. <br />Director of Law Gareau: <br />• On June 1, 2011 an appeal was taken by Norcar Co., LLC (North Olmsted Town <br />Center) from an adverse Board of Zoning Appeals ruling which occurred at the <br />May BZA meeting. At that meeting, one member of the BZA was absent and the <br />vote for a variance request for signage was 2-2 which meant it lost. At the June <br />meeting after the appeal was filed, all BZA members were present and a motion <br />to reconsider was made. At that point the signage was approved by a vote of 3-2. <br />He expects the case will be dismissed. <br />• A mediation hearing took place on May 25, 2011 in the matter of Margaret <br />Benning vs. The City of North Olmsted. Ms. Benning sustained injuries in a fall at <br />the city jail. The insurance defense counsel handled the matter and the Law Dept. <br />was present for the mediation as well. The case was settled for $9,000. <br />• The city received notice that Andrew Mazzella has a claim against the City of <br />North Olmsted. He will likely be dismissing his case in short order. He had <br />previously alleged in a court filing that there was a misuse of a police Taser <br />during an arrest. <br />• There are five new property maintenance cases referred to the Law Dept. for <br />action. Two are for tree issues, two are for landscaping issues and one for <br />signage. <br />• He will be working with the Administration tomorrow regarding the AFSCME <br />reopener for contract negotiations. <br />Director of Finance Copfer: <br />• The auditors have completed their last day of field work today. They are waiting <br />on the Cleveland Division of Water's report on their internal controls. <br />Council President Limpert, Chairman of the Committee of the Whole: <br />The Committee of the Whole met Tuesday, May 24, 2011 at 8:45 p.m. to discuss the <br />redistricting of the wards in North Olmsted. Robert Dykes from Triad Research Group <br />was invited as well as Mark Salling from Cleveland State University. These two firms <br />4 <br /> <br />
