`~: <br />Council Minutes of 04-OS-2011 <br />Director of Law Gareau: <br />• The City of North Olmsted prevailed in the Eight Appellate District Court of <br />Appeals in the matter of the City of North Olmsted vs. Richard R. Reick. The case <br />alleged a violation of a civil protection order that was investigated by the NOPD. <br />The case was prosecuted, briefed and argued in the appellate court by students <br />from the Milton A. Kramer Law Clinic Center at the Case Western Reserve <br />University School of Law. The Law Dept., through Michael Gordillo, partnered a <br />few years ago to provide select law school students an opportunity to prosecute <br />domestic violence, menacing and stalking cases in the Rocky River Municipal <br />Court. <br />• The 2010 Court Report from Rocky River has been issued. The most common <br />felony offenses were theft and felonious assault. The most common <br />misdemeanors were theft, disorderly conduct by virtue of intoxication and <br />domestic violence. There were 52 cases filed for using a cell phone while driving <br />in 2010. <br />Director of Finance Copfer: <br />• The Bond anticipation Notes of $1.365 million are on first reading tonight. There <br />is a $200,000 Ordinance for the Recreation Center, and that is the <br />dehumidification system that is beyond repair. It was discussed during budget <br />hearings, but the price was greater than what they thought it was going to be. <br />• Another municipal income tax distribution was received, so the City is in advance <br />for April. Net profits axe still dramatically down as compared to last year. <br />• In addition to reductions in the local government fund and estate taxes, the CAT <br />tax reimbursement is supposed to decline at a faster rate than what was originally <br />projected. <br />• The auditors have been at City Hall last week and this week. <br />• The Munis system has been upgraded. <br />• The Housing Council meeting was last week. Abatements for the year were <br />approved. <br />Councilman Orlowski, Chairman of the Environmental Control Committee: <br />The Environmental Control Committee met Tuesday, March 22, 2011 at 7:00 p.m. <br />Present were committee members Orlowski, Barker and Brossard; Council President <br />Limpert; Council members Kearney and Schumann; Mayor Kennedy, City Engineer and <br />guests. <br />• Discussed was Resolution 2011-32 which is a Resolution authorizing the Mayor <br />to enter into a Memorandum of Understanding ("MOU") agreement with the <br />Cuyahoga County Soil and Water Conservation District ("SWCD") to provide the <br />City of North Olmsted with Minimum Control Measures 1 & 2 in accordance <br />with the requirements of National Pollutant Discharge Elimination Systems <br />("NPDES") Phase II. At a cost of $5,500 to the City of North Olmsted, we are <br />entering into a Memorandum of Understanding with the Cuyahoga County Soil <br />3 <br />aa,. ,~..u,,, _ , ~ . _ _ . <br />
