<br />Council Minutes of 03-15-2011 <br />• The swat team was utilized for a domestic disturbance on March 7, 2011 when an <br />individual threatened self harm with a handgun. The incident was quickly <br />resolved. <br />• There was a small kitchen fire at a Mastick Road apartment. Damages were <br />$3,000. <br />• The WWTP Superintendent, Sharon Schlemmer, will retire on Apri129, 2011 <br />after 22 years of dedicated service. <br />• The Civil Service Commission has been advised of Police Chief Wayne <br />Wozniak's retirement date of May 6, 2011 after 33 years of dedicated service. <br />• The Board of Control awarded the contract for the energy audits through the <br />County's Municipal Energy Program to URS Corporation. The project will begin <br />this month and end in June. <br />• The Senior Center raised $1,900 from their 2011 garage sale. St. Richard's <br />donated $1,000 to the Cleveland Food Bank. <br />Director of Law Gareau: <br />• He attended and participated in budget meetings with City Council last Thursday <br />and last Saturday. He has been very proud of the performance of his staff over <br />the past year. The budget this year is the same as last year's original <br />appropriation of $282,000 although they ended up a bit higher at the end of last <br />year due to some separation payments. <br />• On March 4, 2011 he issued legal opinion 2011-02 and answered the question of <br />whether the Civil Service Commission acted within its authority when it <br />scheduled a promotional examination for Chief of Police at a meeting earlier that <br />week. He answered the question in the negative and concluded that the Civil <br />Service Commission was outside its jurisdiction without authority when it <br />scheduled an exam without having received notice from the appointing authority <br />of the vacancy; without the vacancy having been formally established by Chief <br />Wozniak. Chief Wozniak tendered thereafter his formal retirement and the <br />promotional examination will be discussed next Monday at the Civil Service <br />Commission meeting. <br />• The Mayor suspended Civil Service Commissioner Michael Ubaldi for <br />malfeasance and misfeasance after it was alleged that he ignored the directive of <br />the Assistant Director of Law -that he had no authority to schedule the exam. He <br />then allegedly, per the Mayor, tried to post notice of the exam after he was <br />advised the Commission was without authority to do so. Per the Charter, aquasi- <br />judicial hearing has been scheduled for next week where the removal will be <br />discussed and reviewed by Council. Two-thirds of Council must agree with the <br />removal. He advised Council to not undertake any individual effort to gain <br />evidence or learn facts about the case and to wait until the hearing is presented. <br />The matter was originally scheduled for Thursday, March 10, 2011 but additional <br />time for the hearing was granted pursuant to Ubaldi's request. <br />• In Fair Housing news, a pending complaint before the board was resolved through <br />conciliation conducted by Carole Heyward. The complaint was filed by the <br />Housing Research and Advocacy Center based upon testing that they had <br />2 <br /> <br />
