He was wondering if the City could compensate <br />him for all of the damages done by back-ups in his home over the years. He does not <br />want to bring a lawsuit against the City. Mayor Kennedy said he talked to Mr. Gifford <br />and his daughter Monday morning and he appreciates them coming to the meeting. The <br />City is undergoing massive amounts of improvements to the WWTP and collections <br />system in hopes they can take the pumps off the street and relieve basement flooding. <br />That project is mandated by the EPA to be done by 2014. The collections system should <br />start some time in 2012. The Mayor and Mr. Gifford agreed to schedule a meeting to talk <br />about this issue further. <br />Dennis Lambert, 25057 Carey Lane said SBS directly affects municipalities. The State <br />law is written to impact how municipalities will negotiate with organized labor. In this <br />particular case, it is something the City will have to look at. Lambert pointed out that <br />Gareau reported about a particular police officer with a particular administrative action. <br />This is a legislative meeting; those are internal affairs. He finds it highly irregular and <br />inappropriate to name employees that are involved in administrative actions in a public <br />session, especially if they have not been resolved. Lambert noted that he has been a <br />regular attendee of Council meetings since 1993, and he has not seen Councilman <br />Schumann too often at the meetings. But, he sees him everywhere else and he is an <br />excellent choice of someone who has been very active in the community. Gareau said he <br />has in the past, tonight and will continue his reports in the future notwithstanding <br />Lambert's opinion about his reports and whether he thinks they are appropriate or not. <br />Gareau said he believes the Council and residents have the right to be advised as to how <br />the resources of the community are being expended in particular matters, especially <br />concerning those matters involving labor. Negotiations, however, are confidential. If <br />someone is talking about negotiations, then Lambert is right. There is no such thing here <br />and he will read his report as he chooses. <br />Terry Groden, 25211 Chase Drive thanked the efforts of the Service Dept., Binggeli, <br />Director Ritenauer and all of the staff put forward in the latest round of storms. He said <br />that he understands that SBS is not even finished and still in committee. Resolution <br />2011-31 appears to be a blanket rejection. So it appears Council is opposing any cost <br />savings to tax payers in North Olmsted that could come from SBS. Proposals in this <br />body come up like this one occasionally where he thinks the body starts to teeter on <br />stepping outside the bounds of their responsibility as Ms. Rudolph alluded to, especially <br />on issues where they may not be speaking on behalf of all residents in North Olmsted. <br />He knows this is a point that this body understands because it was exemplified the time <br />he asked for Council support on unfunded mandates. He was hoping everyone could <br />send a unified message as a City to State lawmakers in Columbus saying -especially in <br />these economic times -this is not the right time to be imposing underfunded or unfunded <br />mandates on public school systems. When he asked for that support, he did not get any. <br />He knows that this body knows that there are certain things they really shouldn't delve <br />into. If Council is in support of rejecting any and all provisions in SBS, and therefore any <br />possible -cost savings that could result from the passage of some form of SBS, then he <br />looks forward to their public support next time the schools are forced to put a levy on the <br />ballot.
