~~. <br />Council Minutes of 02-15-2011 <br />AUDIENCE PARTICIPATION <br />Dennis Lambert, 25057 Carey Lane said most Councils -the Council he was on in <br />Fairview -would hold their executive sessions at the end after all other business was <br />done unless something discussed in executive session also requires an ordinance to be <br />passed under emergency that evening. He feels it is rude to make meeting attendees wait <br />for a half an hour while Council goes into executive session to talk about something that <br />is coming down the road later on. Lambert said his street has not had any special <br />attention over the past five or six years. It is an asphalt over dirt street with no sewer <br />boxes or curbs. The asphalt is now beginning to crack to the point where you can see the <br />dirt beneath. He requested that the City consider doing another complete overlay on <br />Carey Lane and Allendale, and consider doing it in-house. There is a manhole cover that <br />has sunk into the ground at least a foot a few doors down from him. He referenced <br />Councilman Barker's suggestion about leasing land to dealerships to store vehicles and <br />Lambert reminded him about liability that the City would have in that situation. <br />Don Pangrac, 23470 Sharon Drive asked for the status of the waste water rates change. <br />Mayor Kennedy said the City is still waiting for the rates, and they will probably have the <br />rates by the end of the month. Copfer said the overall rates are set to go into effect in <br />2012. Pangrac said he was asking about less than 1 mcf. Mayor Kennedy said they are <br />working on that with no projected implementation date yet. <br />Tom Phillips, 5533 Burns Road said his understanding is that Council had to approve the <br />revised flood plain. If that is true, why weren't those impacted by the revised plain told <br />about it? Gareau said the City did adopt a floodplain zoning which was given to the City <br />by the federal government. There was no specific notice issued with respect to the <br />floodplain designation in North Olmsted. Phillips asked how he can appeal this. Gareau <br />said there is an appeal process available. The Building Commissioner, Dale Mitchell, <br />would have more information regarding this to be able to assist him. Mayor Kennedy <br />recommended setting up a meeting with himself, Dale Mitchell and Phillips. <br />LEGISLATION <br />Ordinance 2010-126 introduced by Mayor Kennedy was given its second reading. An <br />Ordinance repealing Section 1123.15 of the North Olmsted Zoning Code entitled <br />"Expiration of Order," and amending Section 1123.12 of the North Olmsted Zoning code <br />entitled "Appeal Conditions," in order to time limit certain variances granted pursuant to <br />Section 1123.12 and further authorizing the Director of Planning and Development to <br />administratively extend established variance time limitations. Councilman Mahoney <br />moved for adoption. The motion was seconded by Councilman Barker. Roll Call: <br />Mahoney, yes; Barker, yes; Orlowski, no; Brossard, yes; Williamson, yes.
