Council Minutes of 02-01-2011 <br /> <br />monthly loss in over 5 years due to the fire at Arturo's on Brookpark Ext. which <br />resulted in $350,000 in loss. Run volume at the end of January was 25 incidents <br />greater in 2011 than 2010. <br />Director of Law Gareau: <br />• He stated that Council is required to fill the vacant seat of former Councilwoman <br />Nicole Dailey Jones within thirty days. It only requires a simply majority to fill <br />the vacancy including the Council President if there is a 3-3 tie in the nominating <br />process. Because the vacancy occurred thirty days prior to the filing deadline for <br />the November general election and because the vacancy is more than two years <br />prior to the expiration of the term, whoever takes that seat will be required to run <br />in a primary. The filing deadline is 4:00 p.m. June 15, 2011. <br />• The City was named as a defendant in the matter of Frenz vs. Springvale Golf <br />Course and Ballroom in the Cuyahoga County Court of Common Pleas. The <br />complainant alleges she suffered injury while dancing at Springvale. The matter <br />is being handled by insurance defense counsel. <br />• In the area of property maintenance, one case was closed for conviction and one <br />case obtained a conviction and the City is awaiting a sentence. Four cases remain <br />pending, and one case has been authorized for filing. Two cases were abated <br />through compliance with the involvement of the Law Dept. <br />Director of Finance Copfer: <br />• No report. <br />Councilman Mahoney, Vice Chairman of the Building, Zoning and Development <br />Committee: <br />The BZD Committee met Tuesday, January 25, 2011 at 7:15 p.m. Present were <br />committee members Mahoney and Barker; Council President Limpert; Council members <br />Brossard, Kearney, Orlowski and Williamson; Mayor Kennedy; Law Director Gareau <br />and Planning and Development Director Wenger. <br />• First item was CMS 10-37 Exit 2 Storage located at 31399 Industrial Parkway. <br />The proposal consists of an addition of a new 22-vehicle metal storage canopy. <br />The committee voted 2-0 for approval. <br />Councilman Mahoney made a motion to approve CMS10-37 Exit 2 Storage located at <br />31399 Industrial Parkway subject to recommendations and conditions set forth by the <br />Planning Commission. The motion was seconded by Councilman Barker and passed <br />unanimously. CMS 10-37 Exit 2 Storage approved. <br />• Discussed was Ordinance 2011-5 and Ordinance amending and re-establishing <br />Chapter 1359 of the Building Code entitled "Maintenance of Unoccupied <br />Commercial Buildings" in order to provide the Director of Planning and <br />2 <br />
