Council Minutes of 01-18-2011 <br />a`~~fi <br />`~ <br />• He attended the retirement party of Rico, Officer Wagner's police dog today. <br />• Police Chief Wozniak has announced his retire effective April or May of 2011. <br />• The stone and asphalt bids will be opened at noon on January 24, 2011. <br />• He thanked residents and business of North Olmsted -the City came in second <br />place in the 2010 Recycle Your Computer collection events sponsored by the <br />Cuyahoga County Solid Waste District. <br />• The State of the City address is Thursday, January 20, 2011 at 11:30 p.m. at the <br />Radisson. <br />Director of Law Gareau: <br />• The property formerly known as Alexander's Restaurant was purchased last week <br />at a Sheriff's sale by a real estate holding company for Key Bank for the <br />minimum bid. This property has been monitored by the Law Dept. for lingering <br />property maintenance problems, delinquent real estate property taxes and <br />proliferation of Nissan vehicles on the lot. He has contacted Nissan and advised <br />them that they are not permitted to use that lot to store new motor vehicles. <br />• In the matter of Randall Thorne vs Ciry of North Olmsted, Ohio Board of Zoning <br />Appeals in the Court of Common Pleas has been resolved by court order and <br />agreed judgment entry. This is the Surf Shop sweepstakes cafe. It will continue <br />in its current location, but it will comply with our Code which was passed after it <br />came into existence. They will reduce their machines to twenty-five and will <br />otherwise comply with the new Chapter 752. They will seek a license retroactive <br />for 2010. There is additional action before the Ohio Board of Building Appeals <br />which had to do with the Building Commissioner's determination that <br />improvements were undertaken at the location without proper permits. That <br />matter will also be resolved and they will be required to fully comply with the <br />Building Code in the City of North Olmsted. <br />• The Law Dept. participated in a day-long session to mediate claims in the matter <br />of Stofko vs Lee Scott in the United States Federal District Court on January 4, <br />2011. The City and all parties entered into a settlement agreement, the terms of <br />which are confidential. <br />• On January 4, 2011, he participated in the FOP Fact Finding session concerning <br />the contract reopener on wages and benefits. The matter is now being handled by <br />the Fact Finder. <br />• He is working on a re-write of the Ordinance concerning second-hand dealers. <br />• He is currently taking a look at fences -recently there have been a number of <br />fence issues that come before the Board of Zoning Appeals and the Board of <br />Building Code Appeals. Since the same issue is coming back again and again, the <br />Code will be reviewed. <br />• At the last meeting, it was brought to Councilman Mahoney's attention by Dennis <br />Lambert that there was a conflict within the Charter concerning the initiative and <br />referendum process in the City of North Olmsted. He has looked into the matter <br />and there is no conflict. The City is in full compliance with the State Code <br />pursuant to Charter provisions. <br />3 <br /> <br />
