This was denied. An appeal was taken. The Court of Appeals <br />affirmed the denial of the summary judgment motion. That put the case back <br />before the trial court. The trial is scheduled for May 6, 2013. The city's <br />insurance defense counsel is handling this case. <br />• He extended his condolences to the Barda family. <br />Director of Finance Copfer <br />• As far as Munis is concerned, she is working on obtaining the County property <br />file and utilizing that for the city's central property database. This will be used <br />for work orders, alarm and permit billing, building permits and Code <br />~'` enforcement. The County updates the file on a monthly basis and will keep the <br />property file accurate and up to date. For now, they are looking at uploading the <br />basic information of parcel number, street address, property owner, etc. They are <br />also looking to import the ward and precinct for parcels so that they can track <br />activity by those GEO codes. <br />• They are preparing the proper notices to comply with the requirements in the <br />OPERS legislation that went into effect January 7, 2013 regarding independent <br />contractors. A notice of right and request for determination for OPERS <br />membership form was sent to all individuals who provided services prior to the <br />effective date as an independent contractor and was classified as such by the city. <br />This form notifies these individuals that they have one year from January 7, 2013 <br />to request a determination as to whether they should have been classified as a <br />public employee eligible for OPERS membership for these services. As there are <br />no clear guidelines, she, the Law Director and the Human Resources Director <br />determined they would send this to all individuals who received a 1099 from the <br />city for the past 3 years. An independent contractor acknowledgement form is <br />being sent to all individuals who are being treated as an independent contractor <br />after the effective date of this legislation. They are required to retain the <br />completed form indefinitely and to forward a copy to OPERS. <br />• She attended another 208 Plan, which is a NOACA-approved sewer utility <br />provider lines for the region meeting, regarding Olmsted Township customers. <br />:,~. She and the city Engineer reinforced that they would be happy to take additional <br />customers, but are not willing to give existing customers to regional sewer.
