Council Minutes of 08-21-12 <br />"League Appreciation Week" will take place from August 20 through August 24 <br />with food and drink specials in the clubhouse following golf. Councilman <br />TM Kearney has scheduled a Recreation Committee meeting for September 11, 2012 <br />to discuss the Recreation Department and Springvale. <br />Director of Law Gareau: <br />• In the matter of Megan Frenz vs. Sprinvale Golf Course and Ballroom, the city - <br />through insurance defense counsel -took an appeal of the denial of the city's <br />motion for summary judgment on the theory of immunity. The case will go back <br />to the trial court in the Court of Common Pleas and be scheduled for trial on the <br />negligence claim against the City of North Olmsted. <br />• On August 9 the Fact Finder's report was issued for labor negotiations with the <br />Fraternal Order of Police. The FOP accepted the report, Council was briefed last <br />week during executive session and had no objections, so the report is deemed <br />accepted by both sides. <br />• Some time ago, the city expanded its juvenile diversion program to include <br />diversion for juvenile traffic offenders. The juvenile court in Cuyahoga County <br />has reversed itself on this issue and directed that the city ceases using the <br />diversion program for juvenile traffic offenders. However, the city is reviewing <br />the option of running their own diversion program locally for juvenile traffic <br />offenders. It would be a different process than the one that the court has advised <br />the city to stop doing. In the meantime, the program has stopped. <br />• Effective September 1, Carole Heyward will no longer serve in the capacity of <br />Assistant Director of Law as it concerns civil matters. She will continue to work <br />with the Fair Housing Review Board and matters concerning fair housing <br />initiatives. <br />• There are four property maintenance cases pending with convictions and are <br />scheduled for sentencing. Five cases remain opened and ongoing in Rocky River <br />Court. Seven cases are awaiting filing and service. One additional case has been <br />referred to the Law Dept. for prosecution. Three cases are in the process of <br />attempting to work out a resolution within the Law Dept. <br />Director of Finance Copfer: <br />• No Report. <br />Councilman Barker, Chairman of the Finance Committee: <br />The Finance Committee met Tuesday, August 14, 2012 at 8:15 p.m. Present were <br />committee members Barker, Schumann & Kearney; Council members Brossard, <br />Mahoney and Orlowski; Law Director Gareau, Finance Director Copfer, Human <br />Resources Director Farver, Planning/Development Director Wenger and Safety/Service <br />Director Thomas. <br />• Discussed first was Ordinance 2012-66 which is an Ordinance amending Section <br />135.05 of Chapter 135 of the Administrative Code entitled "Department of <br />.~ Finance" in order to further authorize petty cash expenditures within the Division <br />~1iw of Springvale Golf Course, and declaring an emergency.
