Council Minutes of 02-07-2012 <br />fi= <br /> <br />~,:. <br />"Refuse Collection" in order to implement new standards for refuse collection <br />within the City of North Olmsted, and declaring an emergency. This Ordinance is <br />mostly housekeeping clean-up of some of the antiquated language in Chapter 941, <br />Refuse Collection of the Codified Ordinances. The Ordinance more accurately <br />defines single &multi-family structures and adds wording to the commercial <br />structures section. The legislation states the City will not provide waste pick-up <br />for commercial and certain other structures. Section 941.04 (a) which governs the <br />placement & collection of recyclables is modeled after the recyclable definition <br />from Republic Waste. There was a discussion on section 941.01 (c) (1), on the <br />vagueness of wording of this section. Councilwoman Williamson presented a <br />change in wording to more clearly and succinctly define the section for <br />Residential Structures. In line 1, the word all was eliminated, and in line 2 after <br />the word located, the wording on dedicated streets was added. There was a <br />discussion on other wording in the paragraph, the committee & members of <br />Council decided to leave the remainder of the legislation as written. There was a <br />discussion on dedicating existing streets and the Law Director did not believe this <br />will ever be an issue. Several Council members asked about the situation with the <br />Cinnamon Woods Development. The Law Director stated the new language in <br />the Ordinance will not affect the situation with the Cinnamon Woods <br />Condominiums. Their rubbish will continue to be picked-up by Republic Waste <br />and paid for through City Income Tax funds. Even though there are no provisions <br />in the code and no known reason why, under the current legislation, the City will <br />still cover the rubbish pick-up costs for Cinnamon Woods Condominiums. This <br />is a policy decision within the Administration. Mr. Barker made a motion to <br />amend the legislation under section 941.01(c)(1) to remove the word all in line <br />one, on line 2 to add after the word located on dedicated streets, and at the <br />recommendation of the Law Director under section 941.02(a)(1) the number 62 is <br />changed to 73 to accurately reflect the new section of the Zoning Code. The <br />second by Orlowski, the vote was 3-0 by the committee to recommend the <br />amendments to all of Council. Mr. Barker made a motion to recommend the <br />legislation as amended to all of Council, second by Orlowski, the vote was 3-0 by <br />the committee to recommend the legislation with amendments to all of Council. <br />The meeting was adjourned at 7:48 p.m. <br />Councilman Orlowski made a motion to amend Ordinance 2012-5 as previously stated in <br />his report. The motion was seconded by Councilman Barker. Roll Call: Orlowski, yes; <br />Barker, yes; Kearney, yes; Mahoney, yes; Williamson, yes; Schumann, no; Brossard, yes. <br />Ordinance 2012-5 amended 6-1. <br />Mayor Kennedy said that he wanted to clarify that he did not say that the city would <br />continue to pick up Cinnamon Woods. He probably did state that this legislation really <br />has nothing to do with the other discussion at hand on the garbage service which is the <br />pick-up of Cinnamon Woods on private streets. That is the only development the city <br />currently picks up that's private streets. It's a different issue altogether. This is about <br />cleaning up an Ordinance that should have been done 20 years ago and then re-done <br />about a year ago. He said he did not state that they would garbage pick-up. <br />4 <br />
