Council Minutes of 02-07-2012 <br />,;., Mayor Kennedy said 15% of property taxes go to the city with the majority going to <br />;,~ police and fire. The majority of the general fund budget comes from the municipal <br />income tax and is what almost fully funds garbage pick-up. This is strictly an issue of <br />private streets, .and the city has been very consistent on their approach to this issue. He <br />has taken his time to look for any documents that say they should be responsible for trash <br />pick-up in Cinnamon Woods. In fact, he is finding documentation that Cinnamon Woods <br />should be responsible for their trash pick-up and agreed to that in the Council minutes of <br />1998. Fay said he believes all of the residents of North Olmsted should have their trash <br />picked up. <br />Dennis Lambert, 25057 Carey Lane said he is not familiar with the situation but he would <br />like to add some comments. The approach of the Mayor may not be the proper approach, <br />and should go through the city attorney. Every resident is entitled to a trash pick-up. <br />Their have been condo associations in other areas that have sued and won. The pick-up <br />need not be on a private street, meaning there needs to be provisions made for the <br />garbage to be moved to public area where public garbage is picked up. The Law Director <br />should be advising the Mayor on this. Gareau said he indicated in his report that he <br />provided an update to the Mayor on the Ordinance and status of the Ordinance. <br />Carol Cooperider, 30900 Iris Court said it is her understanding that the cities of Bay <br />Village, Rocky River and Westlake provide trash collection at no additional cost to their <br />residents. In 1999 when she moved from Westlake to North Olmsted, this service was <br />provided. She urges Council to consider providing a trash pick-up to all residents like <br />surrounding cities do. <br />David billion, 31143 Lily Lane read the Residential Structures "The city will provide <br />refuse pick up service for all residential structures located in the city in occurrence with <br />schedules and regulations adopted by the Department of Public Service " That is read <br />from the original Ordinance which is being amended to say dedicated streets. That is the <br />major change. <br />LEGISLATION <br />Ordinance 2012-5 introduced by Mayor Kennedy was given its second reading. An <br />Ordinance amending and re-establishing Chapter 941 of the Streets, Utilities and Public <br />Services Code entitled "Refuse Collection" in order to implement new standards for <br />refuse collection within the City of North Olmsted, and declaring an emergency, as <br />amended. <br />Resolution 2012-6 introduced by Mayor Kennedy was given its second reading. A <br />Resolution authorizing the Mayor to purchase a "Vactor Model 2115" Combination <br />Sewer Vacuum & High Pressure Rodder Truck and equipment, at a final cost of <br />$277,500.00, all through the State purchase program; and further authorizing the Mayor <br />to execute all documents necessary to effectuate such purchase, and declaring an <br />.~~,_ emergency. Councilman Barker made a motion to suspend the rule requiring three <br />readings. The motion was seconded by Councilman Schumann and passed unanimously. <br />7 <br /> <br />
