Council Minutes of 06-18-2013 <br />AFSCME concerning a compensation dispute and an AFSCME employee <br />termination. They are in the process of scheduling all three matters for full <br />hearing later this summer. <br />• They have consulted and retained two independent prosecutors to assist in <br />prosecutions because of potential conflicts of interest in the Law Dept. The first <br />concerns a potential criminal conduct of an employee while off the clock. 7'he <br />second concerns a complaint wherein the complaining party or potential victim is <br />also an employee of the city. The hourly rate is $95/hour. These gentlemen will <br />be asked to determine whether to prosecute the cases independent of the Law <br />Dept's input. Both are well known, well regarded prosecutors -Gary Hotz and <br />Mark Schneider. <br />• His Law Clerk has completed her first trial and will be taking the Bar exam. She <br />will be with the city until the Bar results come back in the Fall. <br />• He is working with Director Copfer, Engineer DiFranco and Atty. John Larson on <br />a revised, drafted, amended and restated sewer service agreement with Cuyahoga <br />County. This concerns the township. They would hope to have a contract for <br />approval in August. <br />• He attended the NOCOP meeting last Monday June 10 to discuss the various <br />matters that have been brought to their attention. They will be meeting again next <br />week. <br />• Regarding property maintenance, there are four cases with convictions and <br />sentencing pending, six open cases subject to conviction, five cases with <br />complaints authorizing and awaiting filing and service, one new referral and une <br />complaint open with unresolved issues which just arrived. <br />Director of Finance Copfer <br />• She advised Council that Obamacare is here. The first tax is due in July for <br />patient centered outcome research fees. It's complete with and IRS tax form and <br />cash. <br />• The tax budget for 2014, which is on first reading this evening, is due in the <br />middle of July. The tax budget is a formality which is required for the city to <br />show the county that there is a need to levy the taxes that are on the books and to <br />ensure that debt service is adequately covered. The income tax through the June <br />collection is 1.28% ahead of planned. This is due to net profits being 26% below <br />the prior year, but withholding and individual is 6% over. <br />• Fitch has scheduled a ratings review phone conference at the end of June. They <br />had a desk conference last year to update the rating. <br />Council President Jones, Chairwoman of the Committee of the Whole: <br />The Committee of the Whole met Tuesday June 11, 2013 at 7:46 p.m. Present were <br />Council members Barker, Brossard, Kearney, Orlowski, Schumann, Smith and <br />Williamson; and Council President Jones; Mayor Kennedy, Law Director Gareau and <br />guests. <br />• The purpose of the meeting was to establish committee assignments for the new <br />Council member Smith.
