Council Minutes of 02-OS-2013 <br />~,,,,. North Olmsted in reliance on the zoning. Mr. Schirmer spends over $100,000 a year in <br />taxes for North Olmsted. O'Bryan said this proposed use is an obnoxious, nuisance-type <br />use that can only provide adverse impacts to the commercial property owners and <br />adjacent residential communities. This will also effect the property values of everybody <br />within the district. The purpose of the limited industrial district is to provide a district to <br />serve and promote economic development of the community. Mr. Schmidt admitted <br />during a Planning Commission meeting that there will be gun sales and gun rental here. <br />While there was some indication that gun sales will be ancillary, O'Bryan said he <br />questions if gun sales are the primary purpose here. This meets none of the conditions of <br />a conditional use. If this is allowed to go forward, the property owners in North Olmsted <br />lose their rights to police and regulate this facility. It goes to the regulations of the Chief <br />of the Department of Natural Resources, and those regulations have no "teeth". Gareau <br />said he did speak with Mr. O'Bryan prior to this meeting. He will forward to Council <br />Mr. O'Bryan's legal position on this and give guidance to Council accordingly. <br />Dennis Lambert, 25057 Carey Lane does not envy the position Council and the Law <br />Director are in right now. He is not for or against the firing range. It will be a difficult <br />decision to make, and he advised Council to look at the Ohio Building Codes and Codes <br />that can be implemented regarding this issue. <br />Councilman Barker said that the concept has seemed to have been lost that this is an <br />indoor firing range. The city has had a gun club for over 30 years that shoots trap and <br />skeet outdoors and well as shooting indoors without incident. Ohio became a concealed <br />carry license permit state about 8 to 9 years ago, and the "O.K. Corral" scenario has not <br />happened as a result. <br />LEGISLATION <br />Ordinance 2013-2 introduced by Councilman Orlowski was given its third reading. An <br />Ordinance amending Section 1369.03, "General Requirements for Fences and Screen <br />Walls" of Building Code Chapter 1369 entitled "Fences and Screen Walls" in order to <br />establish additional minimum standards. Councilman Orlowski moved for adoption. The <br />motion was seconded by Councilman Kearney and passed unanimously. Ordinance <br />2013-2 adopted. <br />Resolution 2013-6 introduced by Mayor Kennedy was given its third reading. A <br />Resolution dispensing with the RFP process and authorizing the Mayor to enter into a <br />contract with Cuyahoga County/The Cuyahoga County Engineer for the purpose of <br />providing inspection services for bridges and culverts, and declaring an emergency. <br />Councilman Brossard moved for adoption. The motion was seconded by Councilman <br />Kearney and passed unanimously. Resolution 2013-6 adopted. <br />Ordinance 2013-11 introduced by Councilman Brossard on behalf of himself and Council <br />members Schumann and Barker was given its second reading. An Ordinance amending <br />and re-establishing Section 505.16 entitled "Vicious and Dangerous Animals" of Chapter <br />Five of the Codified Ordinances of the City of North Olmsted in order to add specific <br />4 <br />.>~ . <br />
