<br />Resolution 2013-1 was introduced and placed on first reading by Mayor Kennedy. A
<br />Resolution granting to Morris-Pontiac-GMC, Inc. dba Morris Cadillac-Buick-GMC, Inc.
<br />a second lease of space at the North Olmsted Recreation Center, and declaring an
<br />emergency. Councilman Kearney made a motion to suspend the rules requiring three
<br />readings and formal committee review. The motion was seconded by Councilman
<br />Orlowski and passed unanimously. Councilman Mahoney commented that he approves
<br />of suspending the rules and would like his same comments on 2012-131 to apply.
<br />Councilman Kearney moved for adoption. The motion was seconded by Councilman
<br />Orlowski and passed unanimously. Resolution 2013-1 adopted.
<br />Ordinance 2013-2 was introduced and placed on first reading by Councilman Orlowski.
<br />An Ordinance amending Section 1369.03, "General Requirements for Fences and Screen
<br />Walls" of Building Code Chapter 1369 entitled "Fences and Screen Walls" in order to
<br />establish additional minimum standards.
<br />Ordinance 2013-3 was introduced and placed on first reading by Mayor Kennedy. An
<br />Ordinance amending Section 131.07 of the Administrative Code entitled "Division of
<br />Mayor's Court" in order to establish a petty cash fund for the City of North Olmsted
<br />Mayor's Court, and declaring an emergency. Councilman Barker made a motion to
<br />suspend the rules requiring three readings and formal committee review. The motion was
<br />seconded by Councilman Schumann. Roll Call: Barker, yes; Schumann, yes; Orlowski,
<br />"` yes; Brossard, yes; Williamson, yes; Mahoney, no; Kearney, yes. Rules suspended 6-1.

<br />Ordinance 2013-4 was introduced and placed on first reading by Mayor Kennedy. An
<br />Ordinance amending Section 351.18 of the Traffic Code of the City of North Olmsted
<br />entitled "Parking Ticket Procedures" in order to establish jurisdiction in the North
<br />Olmsted Mayor's Court for the prosecution of parking ticket violations, and declaring an
<br />emergency. Councilman Barker made a motion to suspend the rules requiring three
<br />readings and formal committee review. The motion was seconded by Councilman
<br />Schumann. Roll Call: Barker, yes; Schumann, yes; Kearney, yes; Williamson, yes;
<br />Brossard, yes; Orlowski, no; Mahoney, no with comment. In regards to these three pieces
<br />of legislation (2013-3, 4 and 5) the hallmark recognized by the law is one of called stare
<br />decisis. It basically means consistency. While some things are inevitable in regards to
<br />the Mayor's Court, my opposition was quite vocal, and I am still opposed to the Mayor's
<br />Court. To maintain a consistent position, my vote on all three pieces of legislation is no.
<br />Rules suspended 5-2. Councilman Barker moved for adoption. The motion was
<br />seconded by Councilman Schumann. Roll Call: Barker, yes; Schumann, yes; Mahoney,
<br />no; Brossard, yes; Orlowski, no; Kearney, yes; Williamson, yes. Ordinance 2013-4
<br />adopted 5-2.
